Overstay more than 4 years

I am a regular follower of the informative forum but never posted any topic.

A very long story in short. A good friend of mine has been here on overstay for more than 4 years the reason is had an accident during which he lost his passport, laptop etc. He has been hospitalized for couple of months. After he recovered he was not able to fly back to his home country(Philippines) because he is having 2 Thai kids(he got separated from his Thai wife, not divorced). Earlier he was on Non O visa. Now he is having police report for the lost passport, doctors medical reports, flight ticket, overstay fine 20K and EMERGECY CERTIFICATE from his embassy. Now the kids grand parents (his wife's parents) are willing to take the kids for a month, ofcource for a price, So he is free to go back home and make things in-order(i.e. his legal status).

My questions / concerns:

1.He is taking flight from Don Mueang airport, he will pay the fine for overstay. Will the immigration make any issue regarding his overstay or regarding the EMERGENCY CERTFICATE.

(I would like to remind he is having police report for the lost passport, medical reports and also his kids DOB certificates with his name on it). Will the immigration black list him.

2.He will be back after one month with new passport and TR visa from his home country. He will fly back to Don Mueang, when he is back will there be any issues with the immigration.

any suggestion's/ advice's from all the wise men out there will be much appreciated, particularly from Mr. Ubonjoe.

  1. If he has the 20k needed to pay the fine he should have no issues with the overstay.

Based on current rules he will not be blacklisted and will be free to re-enter.

As mentioned , according to current rules, he should be ok with current plans etc.

In reality the real answer will come when he has a seat on aircraft heading east with passport in hand with no

conditions in same, in regard to any future arrival in Thailand.

My neighbours son, French. has

overstayed by 6 months. If he goes to immigration and pays the 20 thousand

will he be able to get some sort of permit/visa extension or will he be forced to leave with a 1 year ban?

No. If he walks in to an immigration office he will likely be arrested and sent for deportation.

He needs to leave Thailand. He will be allowed to leave as long as he pays the 20k fine at the border. At the moment the proposed bans have not been approved or gone in to force.

Avoid the local immigration. He needs to leave via airport border outside thailand. Arrive with extra 1 hour on top of normal 2-3 hour prior rule for int'l flight. And with 20k baht cash in hand. They'll ask a few questions and then stamp you out after collecting 20k.

He could come back the same day or next, although it is recommended he avoid visa exempt entry after a long overstay. Get at least a single-entry tourist visa at neighbor thai consulate.

If the police report is a few years old he will get some questions why he did not show up earlier. I have no idea what an emergency certificate is. Why did he not get a new passport at the embassy?

Medical records and having kids in Thailand will not help getting in or out the country without the correct papers. But being the parent taking care of the kids can be a reason to get a visa.

Only children over the age of 7 need to pay the fine.

I think he means an Emergency Travel Document (emergency passport) issued by the embassy. Many embassies can't issue new passports.

Some embassies will only issue a emergency travel document (certificate) that is only good for travel to a persons home country. It will be accepted on departure from the country.
