BANGKOK: -- THE CHARTER drafters have agreed to punish the prime minister and other Cabinet members if they fail to follow their job descriptions.

Cabinet members risk losing their positions and the chance to serve in government for two years for failing to follow the guidelines to be included in the upcoming constitution, Udom Rathamarit, spokesman for the Constitution Drafting Commission (CDC), said yesterday.

The duties for Cabinet members were spelled out in a clause of the draft charter to benefit the public and prevent the members from exercising power in a way that would undermine the country's economy, finances or budgeting discipline.

This clause was also intended as a measure to scrutinise the administration, Udom said.

Complaints could be filed with the Constitutional Court if any of the Cabinet members or the prime minister fails to follow the guidelines or has a conflict of interest.

A severe case of conflict of interest could result in a court ruling that requires the entire Cabinet to be dissolved.

The CDC has decided to add more qualifications for the prime minister and other members of the Cabinet, including "evident honesty and exemplary ethical conduct".

The purpose was to make it easier to scrutinise the government leader and his Cabinet, Udom said.

Worachai Hema, a politician from the Pheu Thai Party, warned that if the constitution drafters were stubborn about allowing non-MPs to become prime minister, their draft would eventually be rejected in the national referendum.

"I believe that political parties and their supporters will disagree with the clause that allows non-MPs to become prime minister," he said.

A failure to pass the referendum would severely erode the government's legitimacy. "I don't think people will allow them to write a third constitutional draft," he added.

The Political Reform Steering Committee has suggested to the CDC that it consider tougher punishment for election candidates who win dishonestly, said Wanchai Sornsiri, the panel's spokesman.

They should be subject to a ban for life from contesting an election, in addition to a maximum imprisonment term of 10 years. If the offender is a party leader or party executive, he or shee should be banned from politics for life, he added.

OMG, how are they going to prove that? Finding an honest and ethical politician in Thailand is like looking for a needle in a stack of needles. And that is assuming the ones doing the scrutinizing are honest to begin with.

Every time there is a post having to do with the drafters and anything about the attempt to draft a new Constitution, the entire process seems to be slipping further down the rabbit hole. The attempt to micro manage the behavior of elected officials in a not so well veiled attempt to circumvent a democratic process is a prescription for continued chaos.

That being said, it simple may be the case that Thailand cannot be a democratic country and this should be accepted and the country should be run as a quasi autocratic manner. But, then what happens when the performance, especially with regard to the economy, is a failure? There seems to be an attempt to hold elected officials responsible for non-performance. Of course, this is typical done by voting them out of office. What direction to take has to first reconcile the paradoxes that exist as well as the distribution of power between BKK and the rest of the country.

''evident honesty and exemplary ethical conduct'', they are going to let a Scandinavian become Thai PM ? It's the only area i can think of where one might find a politician with these qualifications, certainly not in Thailand.

My wife isn't doing that much at the moment. Perhaps she could apply for the job.

I like the idea of the extra salary and the armoured Mercedes Benz.

it says honest and ethical, that wipes virtually every thai farmer as well, in fact it wipes a hell of a lot of the populace because they have never been taught these things in the up bringing.

The US constitution started off, and still is not very long, but 200+ years later, we have the 'Federal Register', which circumvents many, many things and gets ever larger by the day (which I utterly detest).

From what I can gather, the CDC is trying draft something similar to a Federal Register, as opposed to a set of basics that can be the backbone of the system.

They truly are trying to micro-manage an idea/concept and it is just ludicrous and doomed to failure, (yet again).

should not be too difficult to follow guidelines rumored to be :

Only 1 potty break every hour

No sleeping at desk

Lunch break limited to 3 hours

Vote yes when told to do so

Change your shirt at least once a week

Do not speak to any media member

Tuck napkin in shirt collar when eating
