In recently approved batch of males getting thai citizenship, my uncle also got approved and already got his ID card now. He has 4 minor children (foreign citizenship) . Today we contacted the SB branch and inquired about the kids getting citizenship based on Thai father, we got the reply that there is no ways for the foreign minor kids to get naturalized based on thai father. They have to qualify on their own after reaching majority age, i.e. normal criteria for people having relationship with thai person i.e. 40,000/month salary etc. and all other requirements. I find it hard to believe. Anybody (Arkady etc,) got any info about whether this information is correct or we got the wrong reply from some SB official who hasn't got a clue?

If memory serves me right, the minor shall apply for neutralized at the same time of their parent.

If I recall correctly.. the minor should have apply to be naturalised together with their parent.. once past this phase, the guy is correct.

The kids were overseas at the time of the father application eight years ago. So they couldn't apply altogether.

I have not seen anything that states the children of a naturalized Thai gets any special route for citizenship even if applying at the same time.

There is a clause for children of a PR holder to get PR not for citizen\ship.

There is an easy route for them to get one year extensions though.

My Cambodian wife, who has held a temporary residence permit for the last 23 years is in the process of applying for the Thai ID card (and thus Thai citizenship), which we will hopefully, and finally, receive this year. Point of the matter is my 6 year old. He was born in Thailand, and can live here forever-as long as he doe not leave the kingdom! He holds a Dutch passport. Problem is that I want to bring him to Holland next year for a 3 month holiday, and then come back to Thailand. According to his Dutch passport - on which he would enter the Kingdom - he would be on overstay after 1 month!

What is this " easy route" you mention, and is it the only way? (we plan on staying in Thailand until he's 12 years old, then move to Europe)

What is your current visa or extension of status here? He could possibley get a non-o visa and then an extension as your dependent.

No sure what your wife's status is. An explanation of what the "temporary residence permit" is needed.

I don't really want to put 800.000 Baht in the bank (my wife is not Thai!), what with the view of leaving Thailand in the foreseeable future. My wife holds a pink ID card, starting with the number 6, and translated it reads:

Identification No. of Non-acquired Thai Nationality Card Holder, no. ...., Thai consanguinity refugee from Koh Kong.

She came to Thailand 25 years ago as a refugee, and is allowed to stay in Thailand as long as she wants, and is also allowed to work legally.

Her number (64) came up last year for people of her status to acquire Thai nationality (and thus a passport) , we are waiting for the papers to move forward. That still leaves the problem of our Thailand born son who currently only has a dutch pasport. His right to reside legally in the Kingdom with his mother is forfeited the moment he leaves Thailand, which seems strange to me!!

If you can prove a income of 65k baht or more the 800k baht in the bank is not needed or you can combine income and money in the bank totaling 800 baht to get an extension based upon retirement if you are 50 or over.

Your child might be able to get a multiple entry non-o visa as your dependent in the Netherlands. Showing yours wife's proof of her allowed stay here would probably help also.

Technically any foreign child born here can stay in the country legally until the leave and re-enter the country. All that is needed when leaving is their birth certificate and passport.

Children under the age of 15 do not pay overstay fines. The new overstay rules (banning for it) do not apply to children under the age of 18. So if you child left and re-entered the country with just a visa exempt entry as a Dutch citizen their would be no penalties.until they get older.

One option would be to risk the overstay. I was given to understand that under the new rules that will shortly be effective they would also apply for children under 15. apparently I was wrongly informed, but who knows what the future will bring in Thailand!

A last option would be to just be stamped out at Hat Lek along with his mother, and walk back in on her Thai ID card/passport and his birthcertificate (born in Trat) and 30 bahtcard from the hospital.

But only 15 days by land which was what was mentioned in the post I was replying to.

What I meant is that he can re-enter Thailand with his mother (who also has a Cambodian ID card) by just walking across the border at Hat Lek. Stamped out on a Dutch passport, turning around and walking back in as a Thai resident with a temporary status. I know, not completely legal perhaps but Thai AND Cambodians from Koh Kong are allowed day passes, or just pay 300 baht for the privilege. Happens all the time.
