Hi Forum,

hope someone can help me out with my questions. Already contacted 2 advertised Lawyers via mail...but It seems they all dont need the money (no reply at all for almost 4 weeks from both).

I am a 36 year old german, know my thai wife for 12 years, we married 2 years ago. End 2016 I do the step and move to thailand for good. Thats where I was trying to get legal advice.

My wife already owns 2 companys for the last 20 years. Next year we are plannig to add another one with me as partner.

There comes the question: Which kind of visa should I apply for first? Non-Immigrant O and than get the company registration done, or right away with the company registration and the Non-Immigrant B to get the work permit

Is there a more easy and a harder way? Are there any pro or cons on any of the two visas?

If someone is in need of more details feel free to ask

If you plan to stay long term you should obtain a single entry "O" visa (based on marriage) prior to arrival. During the last 30 days of the 90 days the visa will provide you should apply for a one year extension of stay based on marriage.

You would be permitted to apply for and hold a work permit whilst having the extension based on marriage.

You can get a work permit and work with a non-o visa or extension of stay based upon marriage. No need for you to get a non-b visa.

A non-o visa easier to get than a non-b visa. The non-o visa only requires your marriage certificate and copies of your wife house book and Id card, A non-b visa requires a work permit and several company documents.

For a B there's a lot of company documentation required, why I say an O is easier.

Just get the marriage certificate and apply for a one year none-o-m visa which good for up to 15 months and very easy to obtain in any Thai embassy or consulate in Germany or as well in Savannaket.

If your company is ready by next year you can still have a work permit on a None-O.

You are advising that the OP applies for an extension of stay based on marriage which is exactly the same as the correct advice from ubonjoe and johnatong, except you incorrectly refer to it as an extension of visa.

As you are married you can get a non 'O' visa to enter the country followed by a 1 year extension of stay based on marriage. This permit to stay will allow you to work, and it is usually the better option as any changes in your employment status do not affect your permission stay.

am so sorry this is so long winded but can anyone advice me in what to do and how to go about extending my visa if the house has not sold by the time I come in June I just want to be able to stay with my wife for a while

You can obtain a one year Multiple Entry "O" visa in Savannakhet, Laos without the need for finances.

The visa will allow multiple 90 day entries whilst valid.

Have you inquired about obtaining the same visa in the UK ? ( The LondonThai Embassy web site has some errors)

You would only need about £8000 to get a one year extension of stay based on marriage. (400,000 Bht, assuming £1= 50 Bht)

Where are you applying because you can get a multiple non immigrant 'O' visa based on being married without needing to show any financial information.

  • Valid for 1 year.
  • You get a 90 day permit of stay on every entry.
  • Every 90 days you must exit/re-enter or apply or an extension of stay.
  • An entry just before the end of the year gives a final 90 day entry giving you nearly 15 months total stay.
  • A 60 day extension of stay is available, once, for any 90 day entry (1,900 baht).
  • A 60 day extension is available on the last entry too, making nearly 17 months possible before needing a new visa.
  • Once you can show 400K in a Thai Bank you can apply for a 1 year extension of stay that will stop the need for border runs.

If for any reason you cant get the multiple entry non 'O' in the UK (I'm sure you can) you could travel here with a tourist visa and get non 'O' from Savannakhet Laos without financial information, or Penang, Malaysia with a minimum of 100K in the bank.

I rang the Thai consulate in Hull and the man told me to get a 6 months one I would have to show I had £5000 in the bank continuously for 6 months or a marriage visa for a year I would have to show I had £17,000 in the bank so the only option he gave me was a single entry one for 3 months so I have to go with that one for the moment until I get to Thailand I think going to Laos would be by best option for the moment if u dont have to show any financial stuff I guess its more harder to obtain a year one in Thailand are they more stricter with them wanting finances proof

when the house is sold it wont be to bad but until then I have to relay on what's in my Thai bank

You can apply for a multiple entry by post to the Embassy in London. They do not require any financial proof regardless of what's written on the website.

But, currently, it is very easy to get another single entry 'O' from many Thai Embassies/Consulates close to Thailand or the multiple entry from Savannakhet.

  1. A copy of your marriage certificate
  2. Copies of you wife's ID card and Tabian Baan (House book)

The web site is in error as both I and elviajero have indicated.

Many people have obtained the visa without problem and without the need to show finance.

I do not know where you live but if anxious it is always possible to apply in person at the Embassy or one of the Consulates ( Not Hull) where, if your application is somehow "faulty", it will not be accepted for processing.

See post 15 for the things you need to enclose with your application.

You could try speaking to the Birmingham Consulate. They are said to be helpful and they are very near (walking distance) to New St. station.

i have just spoken to birmingham consulate and a very nice lady said all i need to do is bring my marriage certificate ect and 3 months worth of bank statements showing wages going in witch I have all and they send it of to London and they get it back and she said most people dont get rejected

so thank you for your support in this matter

Good to know.

I think the Consulates are under far stricter control these days as they have overstepped their authority so much in the past and the Embassy now has to approve all multi entry visas. If you can meet the Birmingham criteria then go for it. As advised they will not send it to London for approval if they think it will be denied.

emailed all my docs to Birmingham like they said yesterday then just my luck the consulate for Birmingham died the other night so they are no longer processing applications as it is closed for the foreseeable future as they sent me a email telling me this so looks like next stop is hull but I think they are so strict for a cat o visa so If I dont get one of those I might go for a 90 day visa or 60 day and try and convert it in Bangkok to a non immigrant visa everywhere else to go is to far for me to travel so here is hoping

Do a mail in to the embassy in London. Don't even bother with Hull they will want to see financial proof. You could also try Liverpool, Cardiff or Glasgow.

​a quick update for you

​I finally got my visa from hull after sending in all my paperwork then going down today and got a year one now am stress free lol up to now anyway

​but I just have a quick question do I have to leave Thailand every 90 days to activate another 90 days and so on till next April and when it comes to the end exit Thailand before exit date and will get another 90 days then can I go to the immigration and get another cat 0 visa or do I have to come back to blighty that I dont really want to do. But at least I have one now

You cannot get a visa in Thailand. You would need to go back to the UK or apply at a Thai Embassy/Consulate in another country. As it stands today you can get a multiple entry non 'O" based on marriage from Savannakeht, Laos without any financial proof or Penang, Malaysia with a minimum of 100K in the bank. Obviously you will need to check again on availability when the time comes.

Anytime you can meet the finacial requirements (400K cash or 40K pm income) you could apply for a 1 year extension of stay without leaving Thailand. That can be done at the end of any of your 90 day stays.

ok thanks for that i got a non immagrant o visa today valid for a year biased on a marriage to a Thai lady so before 90 days are up i can try ad change it to a marriage visa and not leave every 90 days providing I have 400k in the Thai bank is that what u mean anyway least i have till 2017 to figure it out
