Got blacklisted and need help.

Recommended Posts

Did you get blacklisted after the 20th March deadline?

yes, I got blacklisted just about 3 weeks ago .

-----------------------------------

Congratulations.....If i am right you have the honor of being the first one who has actually admitted to being blacklisted on this forum since the new overstay reules went into rffect on 15 March.

There were a good few others who were asking questions regarding quite serious over stays and never to be heard from again. Perhaps that are sharing some state provided accommodation in Bangkok without Internet access? ermm.gif

The ones brought to IDC are usually out of there within 1-2 weeks, so we should have heard from them by now.

I suspect it has been some blacklisting here and there, but mostly not. I guess people are still slipping through.

And I guess not all of those are members here.

Maybe they are still in there trying to somehow get the money for an airfare home.

I believe you still have to pay for your flight home.

Yes, airfare and some miscellaneous expenses.

This would not apply to those leaving voluntarily through airports. It would only affect those arrested. I am a little surprised we have not heard more reports from the former group. Perhaps, they are unwilling to post because they do not want to have people crowing over their misfortune.

It’s quite common that people ask questions and never follow up with what they ended up doing, so I wouldn’t put too much into it.

If you have specific members in mind, you can see when they were last active on their profile page.

There is no blacklist stamp, there is only a deportation stamp. Can mods correct me if I am wrong. This is from an older Thai Visa thread, apparently it says permission of stay cancelled under section 12.7 of the Immigration Act, allowed to leave on xyz date.

Someone I know got this exact stamp, not related to overstay but to other stuff, the only difference being the hand writing.

By the way, can anybody translate for me the hand written text on the first line? I am curious.

What we call blacklisting is, in immigration parlance, a ban from entering Thailand for a specified period of time. With the help of the OP I hope to find out in what manner an entry ban under the Ministerial Order 1/2558 is communicated to the foreigner and if this is in writing, either put in the passport or on a separate piece of paper, I would like to have a copy of it.

The remainder of the text reads "Permission withdrawn. This person is blacklisted under section 12(7) of the Immigration Act BE2522. Permission to depart on 26th January 2013."

Section 12(7) is refusal to admit due to the person "Having behavior which would indicated possible danger to the public or likelihood of being a nuisance or constituting any violence to the peace or safety of the public or to the security of the public or to the security of the nation , or being under warrant of arrest by competent officials of foreign governments", i.e., the police record ...

I am still struggling with this a bit.

I guess that red stamp is as close as we get to a blacklist stamp but I would like to know more about the real background of this person to understand it a bit better.

I get the impression that this person was already in Thailand and then got kicked out causing a blacklisting, or had been in Thailand before and got into the system somehow by doing something wrong, etc.

Or had he an active warrant for his arrest abroad?

Getting some more background info would be great to put things into perspective.

I know of one guy that had an Interpol record. Not involving Thailand at all.

He was wanted by one country and eventually arrested and let go.

He travelled to Thailand and got rejected into the country and he got the exact same stamp as on this link: http://imgur.com/EqSvD7C

Please note that it is not the actual stamp on the picture and I am sure that the text was different but the actual stamp itself was exactly the same.

He was escorted around by a guard in the transit area and put on a plane back to his origin.

I guess the latter stamp doesnt put you on the actual blacklist but more of a persona non grata basis.

The document you got from immigration, in addition to the red stamp in the passport, says that you can appeal the decision within 90 days and this brings us back to this earlier question you posted:

The school tried to clear the overstay but couldn't find an agency that could handle the case and also because I have no embassy in Thailand. I tried reporting to the police but my school stopped me. They told me reporting the situation to the police would have led me to jail. So I let them have it their way. I've been thinking about it now and I've just found out that they were trying to save their own heads . They also cautioned me not to tell the immigration there at Suvarnabhumi the truth - I will like to know if it's possible to get a lawyer and sort things out ? Thanks.

It is quite clear that the school destroyed your passport with the fake extension stamps to save their own skin.

As by law you were personally responsible for getting the extensions of stay you probably would have no success with an appeal if if your passport even with the incriminating evidence were still available, but you might be able to sue the school who hired the agency that got the fake stamps for compensation if you could produce the agency employees as witnesses and if they would give honest testimony, which is highly unlikely, as these witnesses would then themselves be subject to prosecution for their crime of falsification and possibly be sent to jail.

It is a sad story that has got you banned for one year through no real fault of your own. I understand that your employer had previously attended correctly to your extensions of stay for some two years and you had no reason to suspect that he would not continue to do so but outsource the application work to an agency that then engaged in illegal acts to obtain fake entries in your passport.

Although there is most likely nothing you can do, the crooked agent can usually not disappear as easily as the school/immigration office has suggested. Do you have the agent's name (preferably in Thai script)? I think I would try to do a little digging to see if I could find out what the school has been holding back.

A post with an image of a persons ID card removed as it contained full personal details.

My boss is a very good person and I know she has not had a rest since this happened. I understand everything she did was to save me from going to jail as she told me. The problem is I hate to know that I'm suffering for an act committed by some other person who maybe somewhere having a grate time instead of in prison. I don't want to take any actions that will affect my school negatively. I will let it go .

The advice people have given to go to Laos or Cambodia can be dangerous/  If you travel there via Bankok you will almost certainly pass through immigration to transfer, if you do you will be detained by Immigration and posibly returned directly to the place you boarded the plane. If you do make sure you transfer through another country eg Singapore that goes direct from there.

i am so glad that I found such a forum who can help me out. Actually I am from Bangladesh. Last year after my marriage me and my wife made a plan to visit Thailand as previously I have visited many times with my parents and single also. As I love thailand so much so it was my dream to show this country to my wife. So I prepared all the documents and sent it to the travel agent by my company manager. And somehow he lost my wife's bank statement and created a fake one without informing me. And My wife's passport got BL and Mine got VL. Where as i still can provide all the original documents if needed. But never got a chance to reach Thai Embassy for an appointment. So the last time we tried it was in April 2017. More than a year ago. So Can you please tell me how can we get a visa from Bangladesh. And when the blacklisted period will end.

Thanks and waiting for your reply

If your wife is actually blacklisted there should be a stamp in her passport detailing how long the period is.

It seems odd that an iffy bank statement netted a blacklist, did you get rejected at Thai immigration?

Only the embassy in Dhaka can tell you how long  they have blacklisted you from applying for visas.

There is no standard rule for that type of blacklisting.

He appears to be referring to his wife being “blacklisted” by the Embassy from applying for visas due to the fraudulent application. Not blacklisted by Thai immigration.
