EC warns groups selling referendum merchandise

BANGKOK, 5 May 2016 (NNT) – The Election Commission (EC) has warned social media pages selling merchandise to do with the public referendum on the draft constitution that they may be in violation of the referendum act.


EC member Somchai Srisuthiyakorn said he has received a report indicating a social media page that has announced the sale of shirts promoting the upcoming public referendum. He warned the group that if the shirts are deemed to be politically biased in any way they could constitute a violation of the referendum act. The particular violation could result in 10 years imprisonment and a fine of up to 200,000 baht as well as a 5 year ban from politics.

The EC has urged that the group remove the merchandise and all advertisements for it before any charges are filed, noting that if the group has more than 5 members, their punishment may be more severe.

The so-called "independent" EC seems to be very eager to prevent this referendum from being fair according to international standards.

Now if that was a site promoting no shirts, they would be in the prison as I type facing 10 years in prison. How come the I love Prayuth 8 didn't get a warning.

Same like the, yes, there was a bit of corruption, but we put the money back so there's no problem now.

Since when has removing a page before charges are filed, stop the police from doing so anyway?

How much more of this will be endured?! Is there no limit? It degenerates from bad to worse to worst - and on to worstest (if such a superlative existed). Just frigging unbelievable!

The EC states that it is a violation for sale of shirts promoting the upcoming public referendum.

EC has been very clear (except possibly in the case of Suthep) that advocating For or Against the draft charter by publically displaying a placard, poster or shirt is illegal. But how is the sale of a shirt also illegal? The seller is not making any statement per se For or Against the draft charter. It would seem the buyer should be held accountable on how the item is used - not the seller.

EC's position now goes beyond mere promotion of advocacy. It seems that a shirt that simply says "VOTE" in the promotion of the referendum is also illegal. If that is true, then the Five Rivers are complicit in violation of the Referendum Act by promoting people to vote in the referendum.

The end result from the government are endless interpretations of what expression is illegal with no consistency except to stop any public opinion or supply opinion that could be used against the draft charter.

Referendum Act. Nothing allowed to oppose a YES vote. Thai military govt democracy in action, most gloriously!
