After having argued back and forth with several on TV who were positive that Sirote was guilty of criminal malfeasance in the 1997 alleged tax fraud case against Pojamon, I am pleased to say that the AEC did not jump to similar conclusions based on what they read, but instead took the time to find out the facts and have now completely absolved Sirote and two others as per the link below.

Well, on one hand you can say he was cleared, on the other - let off the hook.

Speaking at a press conference was surely damning evidence in the public eye, but apparently that was the only link between Sirote and the case, and it wasn't enough for indictment.

You could say his name was dragged through the mud for nothing, but it was his own public appearance that started it off. He got apples for apples and no one touched his oranges.

No, he was acquitted. Tried through the media, but acquitted by the AEC (that you hold in such high regard). Acquitted. Not guilty. End of story.

To clarify here, the view of the panel, from a source, is, in effect, that he was not responsible for the actions of his staff{??}, who are still under investigation, and it is claimed that those who answered the Shinawatra family letter {asking for opinions about tax payment}, especially Bencha Luicha-roen, who carried out the duty on behalf of the director-general {Sirote} at that time, must take responsibility.

Oddly, the Finance Ministry itself, contemporaneously took a different view, hence his dismissal for dereliction of duty and negligence. Presumably, Sirote may have case for reinstatement or compensation, or maybe not.

There is more to this than was printed in the newspapers. The AEC took the time to find out. Kudos for that.

Reinstatement? Would he want it - I doubt it. However, his pension was returned in tact as it should be.

^ Hm... well in my dealings with very senior officialdom here, I've never seen a critical decision which wasn't bounced upstairs, officially or unofficially {deniable?}. In this case it would appear the buck does not stop here, but down there. By the by, I know a little more than I'll ever type here.

I think even Sirote realises by now it was stupid of him to go on public record with this very sensitive case, and it turned out he had no idea what was going on. Double stupid of him.

Thailand's Shin Corp 2007 net profit down 72 pct

Shin Corp SHIN.BK, Thailand's largest telecoms group, said on Tuesday its 2007 net profit slumped 72 percent due to losses on investments in the media and consumer finance businesses.

Shin Corp, controlled by Singapore's Temasek Holdings [TEM.UL] through two Thai-registered companies, reported a 960 million baht ($30 million) net profit, down from 3.41 billion baht in 2006.

Two analysts surveyed by Reuters had forecast a 2007 net profit of 0.4-3.0 billion baht. Kim Eng Securities said it expected Shin Corp to make a net profit of 6.8 billion baht this year.

The company had a net profit of 730 million baht in the fourth quarter of 2007 compared with a net loss of 1.27 billion baht a year earlier, according to a Reuters calculation.

Shin Corp, valued at $2.9 billion on the Thai bourse, comprises more than 20 companies in the wireless, satellite, Internet and media sectors with Advanced Info Service ADVA.BK contributing more than 80 percent of profits.

AIS, 43-percent owned by Shin Corp, operates Thailand's largest mobile phone network with about 50 percent market share and contributed 6.89 billion baht profits in 2007, down 0.7 percent, Shin Corp said.

Shin Corp booked a 1.38 billion baht loss from the sale of its consumer finance unit Capital OK and a gain of 407 million baht from selling its stake in budget airline Thai AirAsia, the statement said.

Shin Corp sold its wholly-owned Capital OK in the fourth quarter last year after it sold Thai AirAsia in June in a divestment of non-core assets.

It also booked a loss of 2.45 billion baht from its media business in 2007 after the government took over the operating licence of its 53-percent owned subsidiary, ITV, in March.

After the earnings announcement, Shin Corp shares were unchanged at 29.75 baht at 0320 GMT, when the overall Thai stock market .SETI was up 0.44 percent. ($1= 33.87 Baht)

ASC sends tax case to prosecutors

The Assets Scrutiny Committee (ASC) has forwarded to the prosecution the case against four Revenue Dept officials accused of failing to collect tax from two adult children of deposed PM Thaksin Shinawatra. ASC spokesman Sak Korsaengruang said Panthongtae Shinawatra and Pinthongta Shinwatra were accused of dodging taxes on capital gains made on the sale of Shin Corp shares to Temasek at 49.25 baht apiece. They bought the shares from Ample Rich Investment, a Shinwatra family company, at 1 baht each. The four officials were in charge of issuing letters sent to the Shinawatra family about whether they needed to pay tax on the earnings. The ASC also recommended the indictment of Pranee Wetchapruekpitak, an assistant of Thaksin's wife, Potjaman, for allegedly colluding with the four officials. Sak said legal procedures would be similar to the case the ASC brought against Potjaman and her step-brother Bannapot Damapong over not paying tax on earnings from sales of shares in Shinawatra Computer and Communication. AEC: Prosecutors to Handle Tax Case of Thaksin’s Children

The Assets Examination Committee (AEC) yesterday transferred the case against four Revenue Department officials alleged for failing to collect taxes from two children of deposed Prime Minister Thaksin Shinawatra, to the prosecutors for further consideration.

AEC spokesman Sak Korsaengruang reported that both of Thaksin’s oldest children, Pinthongta and Panthongtae Shinawatra were alleged for evading taxes on capital gains attained from their sales of Shin Corp shares to Singapore’s Temesek Holdings in early 2006.

Sak claimed that the four alleged officials were assigned to issue letters informing the Shinawatra family that they would need to pay taxes on their earnings from the sale.

Furthermore, the AEC also recommended the prosecutors to indict Pranee Wetchapruekpitak, an assistant of the deposed premier’s wife, Pojaman, for allegedly cooperating with the four malfeasant officials to help Thaksin’s children escape from paying taxes.

The two accused reportedly, bought 329 million shares of Shin Corp on January 20, 2006 for 1 baht per share from Ample Rich Investments Co., a shell company incorporated in the British Virgins Islands allegedly established by the deposed premier.

Three days after the purchase, Panthongtae and Pinthongta had sold the stocks to Singapore’s Temesek Holdings at 49.25 baht per share via the stock market, without paying any taxes to the Thai government.

The deposed premier also transferred his shareholdings in Ample Rich Investments to both of his children, who were also shareholders and directors of the company.

From investigations on the case’s irregularities, the AEC and the Revenue Department found in late November 2006 that there were different approaches to the laws in taking action against the two accused for failing to pay taxes on their capital gains from the Shin Corp shares sales.

In response to the AEC’s investigation, lawyers of the depose premier’s children argued that both individuals need not to pay taxes since Ample Rich Investments had sold its stocks to Pinthongta and Panthongate for less than the market price of 47 baht per share.

The lawyer claimed that the two accused had merely transferred their money from one company to the other since both owned had previously owned shares in Ample Rich prior to the sale.

Meanwhile, the AEC spokesman said the case of Thaksin’s children would be similar to cases brought against Pojaman and her step-brother Bannapot Damapong for failing to pay taxes on earnings from sales of shares in computer and communication businesses owned by the Shinawatra family.

Sak concluded that the case against Thaksin’s kids will be deliberated by the Criminal Court after the prosecution makes its final ruling on the case.

makes me laugh watching a military installed tribunal trying to exact their arbitrary 'justice', bumping all over due process and stepping over boundaries. bunch of amateurs.

the interim government will never get the so-called tax money they are trying to extort from the shin kids. this much i'm sure. just like the iTV fine, the number here is so fantastically high because newly installed greedy officials want enough to pay themselves off to lessen the penalty or otherwise to make the issue go away. they know they will only have one chance to make the money before the next government is set up. watch for the number to come down as the clock ticks down.

Afaik, the taxes have already been collected, using the money from one of the frozen accounts. I think it has been posted by SJ.

Well... 1,037,970,013 Baht worth of it, according to the Associated Press, which was not part of 63,735,000,801 Baht that was previously frozen. This was above and beyond that.

The amount taken by the Revenu Department, not paid by the son... but taken, after one too many delays and stallings.... was "in the form of stocks, land, and bank accounts."

Revenue dept Siroj and five officials dismissed

Sub-committee on civil service agreed to fire Siroj Siriphanit as director general of the Revenue Department after he found guilty of negligence and malfeasance for failing to collect taxes from the purchases of Shin Corp by the family of ousted prime minister Thaksin Shinawatra.

Five others officials of the department are also fired on the same charges. The order is to take effect within three days.

The sub-committee met Monday morning after the National Counter Corruption Commission recently found probable causes of malfeasance by Siroj Sawatphanich and five revenue officials related to tax exemption for the shares transfer of a brother-in-law of former prime minister Thaksin.

The full NCCC agreed with the report of a sub-committee and found probable causes to believe that Siroj and the five revenue officials had committed dereliction of duty for failing to collect taxes from Banaphot Damapong when receives shares which were transferred from Duangta Wongphakdee.

Duangta is a servant of Thaksin's wife, Pojaman Shinawatra

Court Postpones Verdict on Shin Corp Tax Evasion Case

The Criminal Court has postponed reading a verdict to rule whether former Revenue Department Chief Siroj Sawatphanich is guilty for failing to tax the transfer of 4.5 million Shin Corp shares from the Shinawatra family.

The Criminal Court postponed reading its verdict today to rule whether former Revenue Department Director-General Siroj Sawatphanich and four other state officials are guilty for failing to collect tax from the transfer of 4.5 million Shin Corp shares worth 738 Million Baht from the Shinawatra family.

Ousted Prime Minister Thaksin Shinawatra and his then-wife, Pojaman, transferred the Shin Corp shares to Pojaman's step-brother, Bunnapoj Damapong and Thaksin's household help without paying tax.

The Criminal Court revealed that this case contains a lot of documents and evidence and the court is still unable to finish scrutinising that evidence.

As a result, the court has decided to postpone reading the verdict on this case to February 26 at 9am.

The state prosecutor previously filed a lawsuit against Siroj as well as four other defendants – former Director of the Revenue Department's Legal Office Vichai Juengrukkiat and former Revenue Department's legal advisors Suchinda Sangchompu, Moreerat Bunyasiri, and Kulruedee Sangsayun – accusing them of failing to collect tax, dereliction of duties, and negligence as state officials in line with Criminal Code Articles 154 and 157.

The tax evasion caused the state to lose 270 Million Baht in revenue.

The cases date back to 1999 when Thaksin was forming the Thai Rak Thai Party. Under Thai law, Thaksin was required to sell shares in companies that were doing business with the state. He gave those shares to his relatives and the household help as the Revenue Department ruled they did not have to pay taxes.

Finance Ministry Permanent Secretary Suparat Kawatkul is among seven state officials who the Assets Examination Committee (AEC) yesterday decided to investigate for possible malfeasance in connection with tax payments by the Shinawatra family over its sale of Shin Corp last year.

AEC spokesman Sak Korsaengruang said that the body resolved to set up a panel comprising himself and eight others to look into whether the seven officials were guilty of malfeasance or dereliction of duty in connection with the alleged tax evasion by Pinthongta and Panthongtae Shinawatra, children of former premier Thaksin Shinawatra.

Sak said that according to Article 39 of the Revenue Code, the share sale by Pinthongta and Panthongtae was taxable because they bought the Shin Corp shares outside the stock market as Ample Rich directors. However state officials ruled that the sale was not taxable.

Finance Permanent Secretary Suparat Kawatkul has been sacked from the civil service for abuse of authority in connection with the unlawful appointment of senior officials in 2001.

Finance Minister Korn Chatikavanij yesterday said the decision to sack Suparat had been made by the Finance Ministry's Civil Service Committee after the National Anti-Corruption Commission stood firm on a ruling the official had abused his authority.

In January, the anti-graft agency found the Finance Permanent Secretary guilty of serious disciplinary and criminal violations over the appointment of four Deputy Director-Generals at the Revenue Department when he was the Department Chief. Suparat had changed the criteria to select the department's Deputy Chiefs.

Permanent Secretary for Finance dismissed on corruption charge

BANGKOK, 19 May 2009 (NNT) – The Civil Service Subcommittee, Finance Ministry, announced yesterday its decision to dismiss the Permanent Secretary of the ministry from his post after he was found guilty of a corruption case.

Finance Minister Korn Chatikavanij, asserted yesterday that the Civil Service Subcommittee, Finance Ministry, had decided to discharge Supparat Kwatkul, the Ministry’s Permanent Secretary, from his post after the National Counter Corruption Commission (NCCC) found him guilty of a corruption case.

His wrong doing involved the appointment of 4 Deputy General-Directors of the Excise Department which was not in accordance with related laws.

The discharge was effective as of yesterday.

Mr. Wisut Srisupan, the Ministry’s Deputy Permanent Secretary, was appointed by the ministry as an Acting Permanent Secretary until an official appointment for the post would be made later this month, said Mr. Korn.

ooohhhh - lets all hate taksin. Lets hope he becomes poor.

You guys all sound a little jealous that Taksin has managed to make it so big in his life. What did he use to get there? His brain. He is a very clever man, obviously, and has made millions of dollars and also done his lttle bit of good along the way (increasing the average wage etc) So he made a few mistakes - dont we all?

Now he has been deprived of his job and his face, isnt that enough. Let the poor guy alone.....

1. I suggest you are very wrong in your assertion that people are just jealous of his wealth. I really don't buy that one

2. Very clever man. No.

2.a In one of his first business ventures he tricked his (farang) partner and took over the business and the case is still slowly going thru the courts.

2.b. He got his start in the telecoms business in a dubious tie up and monopoly granted by one of the key generals in the 1992 coup.

3.C. He made millions out of of loaning Thai taxpayers money to the Burmese Thug generals so that they could buy equipment from Taxsin companies. and this case is still slowly working it's way thru the courts and with damning evidence against him.

BOTTOM LINE - HE IS AN UNETHICAL CON MAN.

3. "He did a little bit of good along the way". Well I suggest Thailand or any country expects a lot more from a PM than 'raising the average wage'. Care to offer any other examples of the good he has done?

4. "So he made a few mistakes - dont we all?" Yes your right we all make mistakes. Massive blatant corruption, massive blatant abuse of power, massive blatant destruction of the pillars and checks and balances of democracy, ordering the police to shoot 'drug suspects' on site resulting in the deaths of many innocent people including children . Do you label these examples as 'a few mistakes'?

5. He lost his face and his job. I hope your not complaining that he lost his and therefore is having a hard time to survive, therefore nobody should ever be 'sacked' from their job?

Sorry but I'm waiting for the day he's behind bars where he belongs:

- As punishment for his numerous, blatant and massive scale crimes

- As a deterent to others. (Then we might start to see some capable sincere people enter parliament, people who have a strong and unselfish desire to help Thailand develop and become a more equal and more just society, rather than the leeches and thugs who we currently call politicians.)

The daughters should be bar girls, the son should be a local gay selling his @ss. They should understand how the regular thai people are struggling to survive. But this is of course is "this is thailand" The corrupt gov, rich, corrupt cops, thugs and regular dishonest regular thai are leading the country. All parts of thai cultures. It amaze me that this country survived this long, sigh. :)

AEC says Revenue Department can seize assets of ex-PM’s children

Chairman of the Assets Examination Committee (AEC), Nam Yimyaem (นาม ยิ้มแย้ม), says AEC has already sent a letter to the director-general of the revenue department, requesting him to seize assets of more than one billion baht of the former premier’s children, Panthongtae (พานทองแท้) and Pinthongta (พินทองทา) Shinawatra (ชินวัตร).

Mr Nam said that the AEC was tardy in its seizure of the Shinawatra asset as he was on a recent trip abroad, however Mr Nam said the deputy director-general can make decisions on behalf of the director-general.

Panthongtae loses his appeal on asset examination

The Appeals Court on Friday confirmed the lower court verdict to dismiss Panthongtae Shinawatra's dispute on the mandate of the Asset Examination Committee.

As son of ex-prime minister Thaksin Shinawatra, Panthongtae had his assets frozen by the AEC in 2006. He sued the AEC for what he claimed to be the unlawful impound of assets.

The initial verdict and the appellate review concurred that Panthongtae failed to bring up legal points to make his case merit the judicial review.

The AEC work led to the Supreme Court's ruling in 2009 to seize Bt46 of Bt76 billion wealth of the Shinawatra family.

The daughters should be bar girls, the son should be a local gay selling his @ss. They should understand how the regular thai people are struggling to survive. But this is of course is "this is thailand" The corrupt gov, rich, corrupt cops, thugs and regular dishonest regular thai are leading the country. All parts of thai cultures. How many girls sell their R--souls, to prevent getting pregnant ???-----------its optional as I say--like a contract- between two persons--and it's not any ones business to suggest -what they are ------or do..--other issues I agree with, --Half of the strugglers you mention could do good but abuse what they have on fags wine women and song-mobiles and m/bikes. BUT there are a vast amount that need help. BUT they will not get it from Thais in general.
