Hey

sorry if this the wrong forum to post so feel free to move it to the correct one 

 

Two years ago a very close friend of mine filled all the papers to sell me his car, and paid for it. When I went to the office for registration I was told that this car had been bought under the tax free promotion and would have to pay 100,000 baht in taxes to acquire the vehicle, which I decline for two reasons: the first is that the value of a new car was at 325,000 baht, the second was that it was better to wait for the three years left before officialising  my position. A few days later, my friend died leaving me with the car and the papers.

I,  of course paid for the yearly expense of the car ( tax and insurance )  parked in my building ( never had the heart to use it though )

my question is: next year the five year period will have elapsed. Can I sell it ? Or what to do with it as I am in possession in papers dated before his death ?

If the car is not registered in your name then you cannot sell it because the car is not yet your property.   You will have to get it transferred into your name (if you can do that without the previous owner being present) and presenting the LTD with papers dated 3 years previously may be a challenge. 

 

If you cannot get it transferred into your name then you can do nothing (legal) with the car.

 

If the previous owner had a family here you may find that the car actually became their property on his death regardless of the papers you may hold.

Hello 

thank you so much for the clear answer 

I will try and go to the LTD with the deceased ID, the papers and the certificate of death to see whether they accept it.

otherwise I will have to contact one of his family members and take it from there. 

One question though: can the car be driven, legally that is ( I am not the type to take risks as far as the law is concerned, that is the reason I have never touched it )

it is already a pity to leave the car as it is now

Sounds clearly like a question about inheritance.

You have to check with the family/relatives about it.

 

But your position is less than comfortable.

You have paid for the car without transfer to your name.

You paid yearly expenses for a car that you don't own.

 

Wish you the best with the heirs.
