Notification sent to Ms Yingluck demanding 35 billion baht in compensation

BANGKOK: -- A letter of notification demanding about 35 billion baht in compensation for the loss to the state from the Yingluck administration’s rice pledging scheme has been sent to former prime minister Yingluck Shinawatra.

 

Deputy Finance Minister Visut Srisuphan who signed the letter said he expected the letter would be received by Ms Yingluck within Thursday.

 

He said the letter, in essence, stated the wrongdoings committed by the ex-premier and the loss from the rice pledging scheme which were concluded by the ad hoc panel deliberating liability for wrongful acts.

 

Mr Visut said Ms Yingluck has 30 days to pay up the compensation as demanded otherwise authorities concerned will undertake administrative measures to deal with her.

That's still in the billion realm when talking in dollars. Serious money. Does she really have that much? Does Dad really have that much?

 

Very interesting to see where all that loot goes to once they've vacuumed it up. We (Thais included) will never be privy to that information.

Maybe she can get a soft uncollateralized loan from the government to pay it.

That's been the Prayut government's answer for Thais who can't pay their debts.

Give Yingluck equal treatment.

Unlikely, unless you are an alien from another planet or are living in dreamland.  Almost every country allows administrative agencies, particularly tax collectors, to levy claims against residents.  If they are unpaid, then it can be taken to court by the agency.  The government is merely following the statutory scheme for recovering damages.  In Thailand, a demand for payment must first be made, even among private citizens.

This would be the first time in a long history of failed rise pledging schemes by various governments over the past 30 years, due to rampant corruption, that a former Prime Minister is held solely responsible for the whole <deleted>@#$@Up and forced to pay for it from their own pockets, however deep they may be.

What statute would that be that covers compensation for a failure of a political policy?

I believe that the idea of using an administrative order was because there was no law being violated.

So it remains to see if the government will sue Yingluck in court (Prayut vs Yingluck) or simply invoke Article 44.

Don't worry. Big brother will come to the Fore and return his

30 Billion baht she gave back to him.

He will also pay the taxes from his sale of shares in AIS or whatever it was called.

Yingluk will volunteer for community services to pay off the outstanding.

All is well in Thai justice.

Only executive immunity protects politicians from actions for negligence or malfeasance.  Thailand has no such immunity for its politicians.  Maybe you should try learning about political and legal systems before you jump to conclusions about how these systems usually operate.  An administrative order is merely a claim  for damages which must be adjudicated by the Courts.  Article 44 is irrelevant to the claim.

The ridiculous thing in all of these threads is that some people hate the Shins so much that they will look the other way and pretend its justice as money is stolen from Yingluck, and the witch hunt continues in that regard. You can't ignore the abuse of power simply because you dislike the people who are being abused... or apparently for a lot of expats you can. Which says something about those posters imo.

1.  A special account with bells and whistles? or,

 

2.   Into general revenue where all state income goes.

 

Why would not be 2. above?

'Abuse of power...' Ohh you mean the overall shin abuse of power, best example the incident where the paymaster got a 2 yr jail sentence. And please don't reply with the attempt to divert of '... politically motivated...' because that's not true.

I doubt Yingluck's old dad could help her, he's been dead now for many years.

OTOH her brother Thaksin may be having a whip round with his Arab friends to raise enough to help her.

It's not so much the hate of the Shins, it's the hate of ANYONE who rips off

the average citizen to feather their own nest.

I will condemn any who do so.

The fact is that the Shin family had no problems doing so, but pretended to be the

savior of the poor.

They didn't pretend anything, the poor genuinely preferred them that's why they kept voting them in. They're hardly going to vote PAD, the saviour of the Bangkok elite.

Maybe you should try learning of legal systems, The new ruler here has put into law that he and his cabinet are exempt from any and all criminal or civil prosecution after November 1st 2016. Hence the urgency of getting Yingluck on the chopping block as this law is also retroactive.

Probably sent Postage Due !!!

The check is in the mail. If you haven't backed up the truck yet dear lady your a dead duck. What no checks cash only dear oh dear how many trucks will be needed. We have us a Convoy!! Do the same as upset bill payers in the west do pay it all in satangs. Beware the cupboard may well be bare. Does she have to sell the mushroom farm? Does she get a crime discount for prompt payment? Woe is me so many if buts and maybes. Stay tuned for episode 2 of this soap opera.
