My retirement visa was issued in January 2015 in Australia. Last time It was  extended in May to January 2017 upon my return to Thailand via my single re-entry permit.

I fly out on the 7th of November to Australia for a 3 month stay, thus returning 8 February 2017.

In March 2017 my passport expires so I intend to get a new one in Australia. 

I want to apply for another non immigrant O-A visa once I get my new passport.

( my old visa would have expired when I return ). 

I won't get another re-entry permit as I will be doing the above. 

When the Thai consulate in Sydney receives my passport and new application will it be a problem if it is before 17 January 2017 ? I don't want to apply after this date as it will leave me very little time to process the application before flying back to Thailand.

Copy of reply I made in reply to a post you did in another topic.

They will accept the visa application since your permit to stay will end on the date you are stamped of the country. Also they will never see your old passport if you get a new one.

Your visa expired in January of this year so it is certainly not a factor now.

If you were using a re-entry permit, your visa would have already expired and nothing would have been extended when you re-entered the country. Your permission to stay would simply have been maintained by using the re=entry permit.
