Probation question

Recommended Posts

Hi all,

Simple question: Does a contract stating the employee has a 6 month probation period (can be dismissed with a week notice) have any legal standing over the 119 day probation period law?

Noticed our company has this, and its written in the Thai contract for foreign staff.

I see nothing that mentions a limit or the need for a probation period in the labor protection act.

Did find this in a summary of it here. http://www.thailawonline.com/en/others/labour-law/rights-and-duties-of-employer-and-employee.html

9. Termination of Employment; Severance Pay; Special Severance Pay

Termination of the contract of employment

When an employment is defined a period of termination, a contract of employment must expire upon the completion of the period specified in the contract without the need to give advance notice.
When an employment is not defined a period, an employer can terminate an employment of an employee or an employee can resign a job by giving advance notice in writing to the other party before the next date of a wage payment falls due.
