Overstay with medical certificate, what if I get arrested?

If I have a letter from hospital, (not private clinic) stating that I can't travel with meds and all documents.

 

Can I simply pay the overstay when I leave without problems?

 

If I get arrested, do they still treat it as criminal overstay? Or does the medical documentation protect me?

 

Any lawyer out there can assist me with this?

 

I already asked immigration, and I was told repeatedly by immigration that they only issue ONE extension, and I've had it already, my embassy is not cooperating...

As long as you have hospital documents saying that you cannot travel you can get extensions from Immigration of up to 90 days.

There is no limit on how many extensions you can get.

If you do not have an extension you will be on overstay and will be fined and or arrested.

Are you on overstay already?

I would think a lawyer can help you ,if you pick the right one.

I know of people who have gotten more then one extension on grounds of illness.

The immigration has to be convinced you can not travel as a normal person,maybe go there in an ambulance ?

You were given a lot of advice in your earlier topic here.

Having a medical certificate will be of no help if you get caught with an overstay. If you leave the country with more than 90 days there is a chance you would be banned from re-entering the country.

At 500 baht per day  up to the max of 20k baht that might be enough to pay a lawyer to help get the extension based upon medical treatment.

Just out of interest, when immigration told you they would not issue you another medical extension, did they give you or did you ask them for any advice on what you should do next.

did they not mention or notice that you were already on overstay?

how long is the medical certificate from the hospital valid for and when does it expire?

Not really , the staff were very friendly, but this guy in the office was VERY rude, nearly screaming despite my earmuffs AND plugs, maybe on purpose?

 

This conditions is painful, every sound is like 10 fold, like bionic ears...

 

My first extension was only 20 days, I misjudged the severity of my condition, 3-6 months is better for ears to heal, I don't wish this condition on my worse enemy...

It is completely irrelevant if you misjudged your condition, the only thing that determines your condition is a certified valid medical certificate.

if you don't have this then in the eyes of the law you are an overstayer and in the country illegally.

I misjudged the healing required, first I had only tinnitus, but then acute hyperacusis and autophony developed, my situation deteriorated...

I have all documents from doctors. 

 

Tomorrow I will go again and try again, maybe ask a lawyer also.

Once a person is on overstay a medical certificate is of no help. The fine would still have to be paid paid and if caught it would still mean a trip to the IDC.

The OP must pursue getting an extension before going on an overstay.

1. Can I go to immigation and pay the overstay

2. Go to the doctor and get new documents

3. See lawyer or go back to immigration to attempt again

The basis for my quote was knowing from other posts from the OP that he was already on overstaying and was not forthcoming as to whether he had an up to  date and valid medical certificate when he went and asked immigration for another extension.

1. It depends upon how long the overstay is. If a short one they should let pay for the overstay and apply for the extension.

2.  You mentioned a hospital in your OP. Some larger hospitals have people that assist their patients with extensions. Be sure they know what you need.

3. If needed yes or an a visa agent with contacts at immigration may be able to help you.

I'm now 5 days overstay, my medical extension with valid hospital docs was valid until December 20th.

 

The staff  at immigration were very friendly and cooperative, only the guy in the office was the problem as I stated above.

 

I have been to 3 hospitals and have seen numerous ENT's and audiologists. Everything is documented. 

 

I will take further steps forward tomorrow, if anybody knows anybody with connections or a good lawyer or agent, please send me a PM or post over here.

Larger private hospitals have customers service staff who will assist their patients with obtaining medical extensions at Immigration and will even come to the local Immigration office with the patient.  Some local Imm. offices can be quite specific about the exact format of the doctor's certification, etc.  

 

There is NO LIMIT to how many med. extensions someone can receive.  I know frail, elderly people here in Chiang Mai who have been on  medical extensions for years.  Every 90 days, like clockwork, someone from the assisted living center where they reside takes care of obtaining another medical extension for them and from time-to-time someone from CM Imm. goes out to see the patients just to be sure they still meet the criteria and haven't somehow gotten better and seemingly capable of travel.

Best is you get another statement from the Hospital that your situation still doesnt allow you to travel and of course dated back ,so, you could pay the 5 days overstay and apply for another 90 days extension, which is what the Doctor should recommend as well, because based on the recommendation of the Doctor the IO decides , as we was told recently when applied for medical extension for pregnancy.

My brother has tinnitus, and associated problems with his balance also.

I know what youu feel like, but your place is to see a specialist at a hospital.

As you are apparently doing , document everything.

You will need a doctor's certificate if you can not travel do to balance oroblems.

You cn book a flight with wheelchair assistaance also if required.

The airlines do  this free of extra charge.

I am 70 years old and minimally disabled (walking problems) and  travel by air with a  wheelchair from the airline.

 A German man only had to send his wife with photos and got his extensions based on his medical condition. That went on for about 2 years.

The Medical Cerrificate need to come from Government Hospital before you approach  the Immigration.

If you are overstayed 5 days and intend to stay an addional 60 the worst that will happen is you will be fined 500 per day to a maximum of 20,000 baht 

 

Since you have a  note from the doctor it would seem you will not get banned from Thailand and they will not arrest you if you just go to the 

airport the day of your outgoing flight Pay the fine and go to your home country

They will not arrest you just fine you Thats it

The is no written requirement for that.

Perhaps some immigration offices will want it to be from a government hospital but not all.
