‘Clear civil law violations’ implicate family and employer of driver, insurance carrier

 

CHONBURI: -- THE FAMILIES of 25 people killed when a public-transport van and a pickup truck collided in Chon Buri province this month can seek compensation from various parties, including the late van driver’s family and his employer, according to lawyers. 

 

Law experts have pointed out that the affected families may even sue Transport Co Ltd, which partnered with the van driver’s employer to deliver services that turned deadly on January 2.

 

The horrific accident took place when the van belonging to Ployyok Limited Partnership veered out of its lane and crashed into the pickup travelling in the opposite direction. On impact, the two vehicles erupted in flames, killing 25. Two passengers survived.

How can the driver's family be held responsible  for his actions? 

Great news.  Sad the family may get sued, but great news they can go after the owners.  Hopefully the payouts will be big enough to get these companies to change their deadly policies.  Best of luck to the surviving relatives.

suddenly  all the companies assets  will disappear and the company close down to reopen next week under a slightly  different name

Sue the company for every Satang it's got. Leave the family alone!!

Bad reporting / translation error? The way I read it the lawyer is saying that they could sue the driver's estate (damages limited to the "sum of all the inheritances"), rather than the family. Anything for him to make a dollar !!!

I thought the same until I read on down. The families of the deceased are suing the driver's family for the compensation they will receive for their loss (the driver). Certain amount of logic there although I would have to think more about it.

The Drivers family are most likely potless anyway !     Saddest thing is it will take decades for the case to be settled and meanwhile the company will do a quick name change and carry on as before.

The guy's family will be getting an insurance payout and whatever he left in his estate.   Surely that's fair game.

no  i  dont think  thats fair although  may  well be  correct  here,  the  company  should be  insured  for their drivers  negligent  actions...........fat  chance of  that though

Don't get me wrong, I think that taking it out on the guy's family would be despicable.

 

But if the guy had been worth millions, and had more millions coming from the insurance company, should his family be allowed to benefit while the victims of his negligence go uncompensated?

 

I think the lawyer would have been better had he spoken of suing the guy's estate, not his family.  In effect, they'd be suing the guy for his own actions, but after his death.  

 

And maybe that's a translation and/or reporting thing.

Only a lawyer would come out with such an idiotic claim. Geeze. 

They should be able to sue the government , after all they are responsible for road safety and even for the non education !
