Hello Brains Trust

I need to get our Australian marriage certificate and birth certificates of our children "certified by the Thai government" (as told to me by Kanchanaburi immigration) they told me to go to the department of foreign affairs in Chang Wattana. Well I have been told many different things by many different people in immigration so I am checking is that right and where exactly do I go?

I have done a search but couldn't find an answer it is probably a pretty common question so I am sorry if it has been asked for.

To apply for an extension of stay based upon marriage at immigration your foreign marriage would have to be registered at an Amphoe to get a Kor Ror 22 mariage registry.

You would have to have your marriage certificate from Australia legalized by the embassy or if they cannot do it the Amphe would accept a self certification by doing a statutory declaration it is true and correct. Then your marriage certificate and the certification would have to be translated to Thai and the translation certified by department of consular affairs in Bangkok.

Then you would go to the local Amphoe to register your marriage.

Have you obtained Thai birth certificates by registering their birth at Thai embassy in Australia?

You don't need to show your childrens birth certificates to get an extension at immigration but it does help smooth things out.

No we haven't registered the children's birth they were all born in Australia and I have no concerns about registering our daughters but I am reluctant to register our son due to the military service thing.

So they need translating also? Hmm they never mentioned that at immigration- they are leading me down the wrong path again - oh the joys of Thai immigration.

So I am going to need a trip to Bangkok to go to the embassy to get them certified by the Australian embassy not the department of foreign affairs? Then back to Kanchanaburi to get a kor ror 22.

The birth registration can only be done at the embassy in Canberra or the consulate in Sydney to get Thai birth certificates. Without a Thai birth certificate they have no proof of having Thai nationality which would allow them to get Thai passports.

Registering you son's birth does not expose him to the draft. He would have to be registered at an Amphoe to get a Thai ID number and house book registration to be subject to the draft. IMO registering him and facing the chances of the draft later is the best option. There are ways to get around the draft and nobody knows if there will be one several years in the future dependent upon his age now.

It is your marriage certificate that needs to be certified, translated and then translation certified.

Your childrens birth certificates would only need to be certified. No need for a translation since they are in English.

How are you children staying here in the country?

You evidently have a non-o visa entry that you want to extend.

The only extensions your children can get are ones for being Thai nationals since there are not allowed one based upon your extension based upon marriage.

We all got non o valid for a year in Australia before we left

Yes we want to extend the non o's

So the children need different documents to extend their visas. Which is probably going to include their birth certificates.

Visas are not extended. You can extend any of the 90 day entries from the visas for one year at immigration during the last 30 days on any of the 90 day entries.

You can extend your entry based upon marriage to a Thai. You will need 400k baht in a Thai bank for 2 months or proof of 40k baht income.

You children would a apply as Thai nationals. The will need their birth certificates and their mother's ID card and house book registry to prove their mother is Thai.

This is the clause of the police order they would apply under.

Each permission shall be granted for no more than one year.
(1) Must have evidence that the applicant used to have Thai nationality or that his her parent is or was of Thai nationality.

We are a bit of an unusual case as the farang (me) is the mother and my husband is Thai.

I think that confuses immigration even more because they don't quite know what is required of us - for example we have been told that we don't need evidence of funds as my husband is Thai.

Sorry for the confusion. Not that unusual but not that common. Just change wife to husband and mother to father in my posts.

You don't need to show financial proof but your husband could be asked to show a small amount of income.

Great thanks for your help wish me luck!

The funny thing is I do Australian visas and when I am trying to deal with Thai immigration it is so disorganised and all over the place it sends me a bit crazy.
