PM asked to sack the revenue department chief if he allows Shinawatra family off the hook over capital gains tax payment

BANGKOK: -- The vice chairman of the anti-corruption panel of the National Reform Steering Assembly urged Prime Minister Prayut Chan-ocha to sack director-general of the Revenue Department if the latter lets the Shinawatra family off the hook from the responsibility to pay capital gains tax over the Shin Corp’s share deal with Singapore’s Temasek Holdings back in 2006.

 

Mr Charnchai Issarasenarak, former Democrat MP of Nakhon Nayok and a member of the NRSA, said Thursday that the Supreme Court’s criminal division for political office holders had ruled on February 26, 2010 that the sale of the Shinawatra family’s stake in Shin Corp to Temasek Holdings through nominees in 2006 worth about 73 billion baht was subjected to capital gains tax.

 

The court ordered former prime minister Thaskin Shinawatra and his two siblings, Mr Panthongtae and Ms Pinthongta, to pay capital gains tax for the share transaction.

 

Charnchai said the court’s ruling meant that the Revenue Department could immediately demand tax payment from the Shinawatra family.

A complete symphony of weak thin skinned persons completely lacking in anything even resembling a backbone or even the most rudimentary grip on common sense, embarrassing but there will probably be some people with the advantage of a decent western education telling us how this is actually a good thing.....

But didn't the Supreme Court also rule in 2010 that the shares belonged to Thaksin and not his children when they ruled to seize his assets. The seizure of those assets also included this tax. Now if that is true, how can the current government claim the children should pay the tax on assets that their father has already paid. Whether we like this family or not,, the issue is applying the law without bias not seeking vendettas.

Thaksin transfer shares, according to Thai law you don't have to pay tax if it is shares. Its a close case. The law they broke is that they lied about the transaction, not sure what it falls under. But perhaps all they did was mislead the media and no laws were broken too under close scrutiny.

I don't get it.. if the court ordered them to pay tax.. then its all legal and they have to pay. Why not enforce it (maybe worried about violence). 

 

They got a court verdict.. not enforcing it is negligence and causes damages to the country because it loses money.

 

Now if there was no court verdict and it was not clear that they had to pay I can understand that it takes time to investigate and then decide what to do.

Scorched earth policy towards political enemies and the "wrong" religious sect(s) continues.

 

Why they wait until 3 weeks before the Statue of Limitations will expire is beyond me? But I guess they can Article 44 it to get around that "legality"?

 

Assuming they can delay "elections" until late 2018/early 2019 (and people made fun of those who suggested it might be 2020 before elections were held) they only have 18 - 24 months to get rid of the evil red threat.

I think that after the courts ruled they had to pay the PTP came in power and did not enforce the order of the courts (of course not it was against one of their own).

 

After that the junta should have picked it up a lot faster, I really don't understand why someone would not enforce a court decision. Negligence from the PTP and junta.

The 46B Baht confiscation more than cover the tax. Trust the military government then and now to arbitrary seize assets from opponents even without due judiciary diligence.

My foot comes down on the side "its a vendetta" This guys future is toast to even entertain the idea.

There is more to this than meets the eye. Reading several offshore reports, T and a certain powerful party are talking and Uncle Too is in danger of being somewhat sidelined. Interesting times but Thaksin's long game is paying off.

I am surprised you have so many posts with comments like that. If you care to take the trouble to read it in its context,  you will understand that it was with respect to the

"goings on in house". But clearly establishmentarians like yourself with rose tinted glasses perhaps have no need to read things clearly. Like your friends, the Elite lapdogs, perhaps who have no hope of being elected and are so incompetent at governing as can now been seen,,  they remove democratically elected governments by force to ensure they all get their big snouts back in the trough ?

Witches were usually someone persecuted because they didn't conform; blamed for something people didn't understand or fitted up because someone wanted their money, land, spouse or whatever.

 

Shins actually have done things which are illegal. They might be being brought to justice whilst others are not but that doesn't make it a witch hunt.

No surprises here. We get many posts, usually from the same few posters, that want to convince us that the Shins are really the people's party trying to bring a better fairer society for all rather than the thieving bunch of corrupt criminals out to suck the country dry.

 

Based on their actions when in power - the Shins certainly ain't remotely interested in democracy, meaningful social reforms, or the truth. But they did get hugely more wealthier during the years PTP were in power, which their egotistical leader couldn't resist bragging about.
