(Sorry my English not so good)

My 90days run out, but I have an idea!

Can I let a Thai-company employed me, and can the thaicompany fix A Year Visa for me without me to leave the country for an thaiambassad?

1. You are on overstay from your post.

2. A Thai company can not "just hire" a foreigner - they have very demanding conditions they have to meet.

3. You have no presented any qualifications for employment - normal is English teaching and that seems out.

4. A visa, unless you have a tourist visa that can be changed by immigration, will require a visit to a Consulate outside of Thailand.

5. No visa is available that lasts one year without leaving the country - only an extension of stay from immigration allows that.

6. A Thai company can not "fix a year visa" in any case - the most they can do is provide job offer and company paperwork to allow you to obtain a visa.

Hehe, no no not english teacher....

But, yes, I have a company that need my "work"....

If, I first get a Tourist Visa, can I change this to an "One Year Visa" with help of my "work"?

Not without company paperwork that proves income to pay you (and naturally meeting the requirement to even hire a foreigner) and under new guidelines that can not be obtained for new company for a year or so.

You can not "change to a one year visa". If you meet the requirements for extension of stay then you could change the tourist visa to a non immigrant 90 day visa and then extend your stay. But extension requirements are not the same as work permit requirements.

I have just began the new company registration and I am going to go for my visa and work permit but your post sounds as if a new company can not be issued any visa's is this what you meant? Can you offer more information?

You can not "change to a one year visa". If you meet the requirements for extension of stay then you could change the tourist visa to a non immigrant 90 day visa and then extend your stay. But extension requirements are not the same as work permit requirements.

Please read recent Sunbelt posts. There are new requirements and believe one is a yearly audit that you will not have and another is a profit to pay salary. So in effect start up company will not qualify immediately. But I am no expert so if anyone can fill in the blanks please do.

I am no expert either but I understand what Lopburi says to be true too. Any company needs to show actual profit in terms of audited accounts in order for a work permit to be granted, regardless of how much financial backing is in place.

Like I said though, I am no expert but this is what I understand from posts here and from what my Thai HR colleagues are telling me.

As for the visa... as this would be a start up company, you could not get a extension of stay based on business until at least Jan 2008 as you need a annual audit which states your company has a balance sheet of one million Baht and had gross sales in 2007 which would be higher than your annual salaries of all foreigners in the company for 2008. This is in Bkk, in Pattaya they require that its annual net profit which must be higher than the salaries of the foreigners for the following year.

Example: Your company had a annual turnover of 1.2 million in 2007. This is higher than the 600,000 Baht salary you will have in 2008. You meet this criteria in BKK. You now have other criteria which must be met such as number of Thai employees ( 4 Thais per work permit) ,you are getting a 50K month salary as you are European/American, the company put a flyer up advertising your position and noone was qualified, that responded, your balance sheet shows at least one million Baht. These are the main criteria that must be met.

In 2007, you would get a one year multi entry visa with a work permit. You would not need to employ any Thais ( if you applied in BKK) ,get a 50K salary per month or even show a profit for the company. You would simply go outside Thailand every 90 days and then revalidate your work permit.

Only once your company was established could you be getting the long term visa. Immigration rules are much tougher than the Labor Dept.

Please note: If your company has Board of Investment promotions, you would qualify right away for the long term visa regardless that you do not have a audit or the number of Thais employed.

Any company needs to show actual profit in terms of audited accounts in order for a work permit to be granted, regardless of how much financial backing is in place.

This is not correct for the first several years of the company being established.
