Tax Non Resident

Featured Replies

If I move to Thailand this year for work (and am in Thailand less than 180 days) and continue to be paid by my company overseas, am I liable for tax in Thailand on that income received (and not remitted to Thailand)? The company will pay me some local allowances for accommodation which I assume will be taxed in Thailand.

You will have or require a work permit for this so yes you or your company will be liable to pay Thai taxes as you will be inbthe system
If you dont have a work permit then that is a different issue and you wont be in the system but are open to a whole host of other problems should you be found working

What if one was "volunteering" ?

Yes for the work permit. So the overseas income would be taxable even though it stays overseas. That's what I'd expect but from the way the regulations are worded it could be interpreted otherwise.

Dont know for positive but I'm sure I have read on here a while ago that even volunteers need a permit (probably depends on the officials in that particular area)
OP is about working?

Yes a volunteer needs a work permit but if they are working for free what are the tax liabilities ?

In order to get the work permit you will need to have some income earned here and be working a company registered here.

What type of visa do you expect to get.

How can you pay tax on nothing?

None since they would be working with a registered organization not subject to taxes.

it is my understanding there is no income requirement for a work permit. but there is for an extension of stay based on employment.

Am I wrong in my understanding ?

Thanks. I'd be on a spouse visa, which will allow my company to get a work permit. All above board and legal. It's just with my salary still being off shore and being less than 180 days in country in 2017 I wasn't sure whether or would be liable for tax if it stays off shore.

There is no minimum income requirement. But you would have to be employed by a company which means you would earn some amount of income.

So maybe my local allowances can be the local income and my overseas salary stays off the radar.

As non resident do the progressive tax rates still apply, but without the allowances and deductions, or is a 15% rate applied to all income? I've seen both mentioned on different websites.
