CDC to send third organic law to NLA for deliberation

The Constitution Drafting Commission (CDC) plans to submit a third organic charter bill it has been working on to the National Legislative Assembly for deliberation and passage into law.

 

The organic law, a criminal code for proceedings against political office-holders, will see at least four major changes, according to the CDC spokesperson Udom Rattaamarit.

 

The first point is that a court can proceed with its own investigation in order to find as much evidence as possible and establish facts. The second point is the court can have a panel of no less than seven judges, not nine like before, to make proceedings against these people easier. 

 

The third point is the court can proceed with a case without the accused being present. The final point is that the accused can appeal if they have new evidence or new legal interpretations to show.

The trier of facts can develop its own facts? Amazing Thailand.

If the prosecution fails admissible or adequate evidence for conviction, the court can add its own set of facts to deliver a conviction? How can this be part of any check and balance system to protect human rights and liberties? Amazing Thailand.

Which further raises the issue of how a defendant can even challenge the court's own investigation?

 

These new court proceedings against political office-holders seem designed to assure arbitrary and capricious convictions that can be politicized to an extent to favor an authoritarian establishment(ie., Deep State) agenda that may not necessarily be an elected government.

I am certain these laws will used equally against all political office holders. Just kidding.

 

These laws just make it easier to get rid of governments that the powers-that-be don't like, without having to mobilize the yellows, and then call in the Army for yet another coup.

 

As if they couldn't dispose of political office holders they didn't like - oh my god, a cooking show, bad man - before with the selective application of dodgy laws.

Yes. Another failed attempt at justice. The role of the court is to make judgement on the evidence presented by both sides and compare to their interpretation of the law. 

 

The more they try, the more they prove themselves to be clueless.
