I have a little boy to a Thai woman. My name on the BC but as we weren't married I am not recognized as the legal father in thailand. We have split up and it is highly likely he will stay with me. I have just about completed the legitimacy process through the courts now which will make me his legal dad.

 

I know if a Thai woman with a child marries another man, the child automatically becomes that man's legal son even though not the birth father.

A couple of questions...

 

If I am legitimized as the father through the courts and she remarried....what status or rights would her husband have as regards to my son?

 

If I am legitimized as the father, and I marry a Thai woman...would she be recognized in any way legally as his mother?

 

If I married a Thai woman that was a government teacher...would my son receive benefits ie free schooling and uni, better medical care same as if he was her real son?

You are the legal father and she is the legal mother, period. Her or you remarrying doesn't change that in any way.

 

Nothing in Thai law states that as a woman (or father) divorces and remarries the new husband becomes the legal father.

If the child is with you, the new husband will most likely be relieved and not that interested. Unless you have shared custody, in which case, he will probably be not that interested.

If your new government worker wife adopted him legally he would get all those benefits. 

But you and new wife would need the signature of his birth mother to give up her son.

Probably not likely.
