FM: Yingluck’s passport cannot yet be revoked

The revocation of former prime minister Yingluck Shinawatra’s passport cannot yet be done as the legal case against her has not yet been concluded, said Foreign Ministry spokesperson Bussadee Santipitaks.

 

The question of whether Ms Yingluck’s passport can be revoked was raised after she failed to show up for the ruling by the Supreme Court’s Criminal Division for Holders of Political Positions on the rice-pledging case against her. It has been widely speculated that she has fled abroad.

 

Ms Bussadee, director-general of the ministry’s Information Department, said the legal case against her has not been concluded because she fled the country and the court has rescheduled Sept 27 for the reading of the judgement.

 

Moreover, after the the court has delivered the ruling, Ms Yingluck can still lodge an appeal, she said.

They're just following protocol like every other country, right? The old rule of law.

Knowing the way these crooked people work, regardless of the situation, I suspect the passport will not be revoked for a very long time, if ever. Once she has confirmed she has a new one from somewhere else, will probably be when they get round to it.

Either Thais are dumb or they believe Thais are dumb.
Passports do not belong to the person issued the passport but belong to the country issuing the passport and can be revoked at any time.

If she's anywhere close to her bro, she probably has several passports already. I read recently that she has one from Nicaragua.  Is it diplomatic, like big brother's?  When you're filthy rich, you can get passports passed to you as easily as Trump hands out breath mints, after taking married women out shopping for couches.

 

I had a diplomatic passport when I was a kid.  My dad worked in the US diplomatic corps.  The passport was black with gold leaf lettering.  The last time I used it, I was coming in from Madrid Spain to Dulles Airport near Wash DC.  20 yrs old, dirty blond hair below my shoulders.  I had a guitar amp.  Custom's officials told me they needed to open the back of my large heavy speaker cabinet (with amp) to see whether I was smuggling hashish.  I knew, with my passport, I could protest them doing so, but I didn't resist.  Nothing untoward was found. The 5 Customs officials looked disappointed.  They thought for sure I was smuggling.

Sure, but only the worst regimes in the world revoke passports of their own citizens without due course.

 

As she hasn't been convicted yet and it is unclear where she is, we can't know for sure she is doing a runner yet. 

Maybe she will be declared innocent and she is in bed with vertigo at her residence. Maybe she will be present when they read her verdict next round and everything will be well.

Well the Director General of  the Information Dept says she has fled the country, as where other Dept have no idea & is still open for speculation

So any person who jumps bail and flees the country cannot have their passport(s) revoked until a court delivers a verdict in the original case.

 

Interesting - so the fact someone absconds, breaks their bail oath, and has an arrest warrant issued for them is irrelevant?

So you think it's ok to jump bail, abscond break a bail oath,  and not have your passport revoked? And the arrest warrant - is that irrelevant to?

 

Most countries consider bail jumpers to be fugitives, issue an arrest warrant and revoke their passports. As bail jumping is an offense in itself in many countries, that is due course.

Based on what grounds, she hasn't been proven guilty "yet", but they have seized her assets haven't they, can you see where this is going, its a great day for a Junta party, she is out of pocket before being proven guilty and we all know what the (set-up) ruling would have been, just take a look at Thailand's law system.

 

Yes Thai's are dumb, you got that right, and she is one above them, hence fleeing before the verdict.

They can shut down a mine but they can't revoke a passport. Amazing.

 

When Thais say there is rule of law here, I don't care. Whatever helps them think people take them seriously on the world stage. When a foreigner does it, it's just embarrassing.

The court isued an arrest warrant so she is technically a fugertive. I would assume.

It is a very normal practice in many countries to block their passports.

Is this a new Law they just invented.

I bet a lot of top ministers, police, army are all worried, saying F*^* did not know this law.

Not "technically" but is a fugitive. Anyone with an outstanding warrant is a fugitive. 

 

It's seems everyone here makes up there own versions to everything as they go along!

And then they all spend hours and hours, and large amounts of money, arguing over it and who was right and wrong!

 

With the affect that what they want to happen happens; and what they don't want to happen stagnates!

 

And they think farangs all worry too much!

Which apparently includes several branches of government, this one seems to believe jumping bail is insufficient grounds to revoke her passport. Maybe they are economical with the truth and she did not jump bail at all. A week has passed and we don't know where she is, let alone how she got there. Neither does the government allegedly.

The US IRS can do it if they believe you owe them 50K in taxes and/or penalties.

In the Australian Judicial system if a defendant is considered a flight risk they must surrender their passport before bail is granted. Seems that could be a solution for Thailand to consider in the future.

Not really. I think there are Geneva Convention rules that you can't make a citizen stateless. She definitely has other passports so not really an issue here.

Even when British government revoked the passports of people going to fight for Isis they can only do so to the dual nationals.

At this point it doesn't matter whether she is innocent or not.
She is a "fugitive" from the law on the run, which in itself is a crime.
