As I posted elsewhere I believe he is in a "catch 22" situation in that if he does not take WSJ to court it is seen as a tacit admission and that if he ends up in court with full public disclosure it is the last thing he wants! He has had to sue hoping to use his usual bullying tactics to kill the story.
