I have a non immigrant O visa with an annual extension based on marriage, but the proof of income is derived from working for my wife's company, with a work permit. I have just renewed the work permit, and would normally now be going through the process of getting my extension renewed, as the extension runs out on 5th October; however, my father in the UK has just died, and I need to return to the UK to deal with everything and attend the funeral. Does anyone know whether I can do so, letting the extension expire, and get a new non immigrant O visa in the UK while I am there without any impact on the work permit validity? I also plan to change my extension to being a lump sum rather than income, as there will be less paperwork involved, if that is possible. Also does anyone know if I can get a few days extension on an extension, as ideally I want to fly on 8th October but don't want to overstay? Thanks in advance for any helpful replies.

Perhaps he is concerned about the report back date 30 days later that will be on the under consideration stamp.

You could apply for a 60 day extension to visit your wife and then get a single re-entry permit so you could apply for the one year extension when your return.

Not a problem to do that. The 400k baht will need to be in a Thai bank for 2 months on the date you apply for the extension.

Re-entering with a new Non 'O' visa won't have any impact on your work permit as you'd have legitimate permission to stay that, being married, allows you to work.

 

You could easily get a new single or multiple entry visa with just copies of your marriage certificate and wife's ID. No financials needed.

Two things - the paperwork I require is prepared by a local accountant/law firm (because of the connection to the company and income/work permit) and they charge quite a lot for doing so in my opinion and do not have a great record of doing it quickly, plus as mentioned I want to change to the lump sum unconnected to the company/job/income as it will be less complicated, and done easily by myself. However I won't have those funds in place until I return from the UK.

Thanks for your advice but are you sure I can get the 60 day extension on top of my year extension? I actually only need a few days extra to avoid overstay, and the 60 day would only enable me to have time for the same extension method as before, not the lump sum, as that money is not in the Thai bank yet. I will probably go and see immigration tomorrow anyway to check my options but the main thing concerning me is whether my newly renewed work permit will still be valid if I get a new visa in the UK, which they probably won't be able to answer.

It has had the same incorrect info on for a long time now. Many people have gotten the non-o visa based upon marriage without showing andy financial proof (do a search and your will find the reports). They also don't ask to see the 20k baht for any visa.

Also a little math will show you the 1,400 pounds is also incorrect. That is the income (65k baht) needed for a retirement extension or to get a OA visa.

Yes you can get the 60 day extension of your one year extension unless you have gotten a 60 day extension since you entered the country with a visa that allowed you to apply for the extension.

The 60 day extension is the only extension you can apply for. But getting a re-entry permit will not help you since you will not have 400k baht in the bank for 2 months before the end of the 60 days.

Your work permit will remain valid if you get a non-o visa while in the UK. Only if you entered the country on a visa exempt or tourist visa could it be affected.

The website has shown that requirement for years, and it continues even after the recent website revamp. It could be a mistake, or it could be a requirement that simply isn't enforced, as the "evidence of adequate finance" isn't. They can, like all consular services, request any additional documents they want on a case by case basis. However, for years, they have routinely issued the visa with only a copy of the marriage certificate and wife's ID.

Just a quick update - I popped into immigration (Hua Hin) to confirm the info on the 60 day extension, and was told I can do it, which I will be doing today. Unsurprisingly I have not yet had any reply to the email I sent to the Thai Embassy in London asking about what is required to obtain the non O visa, even though I have got one before, but the last one was about six years ago, so I think it should be seen by them as reasonable to confirm with the embassy before departing Thailand! Needless to say I will be taking everything bar the kitchen sink with me to make sure I don't have a problem...

i got a single non 'o' in london in May this year. no financials then. just copy of marriage cert and wifes id
