Hello, seeking some suggestions and information. My husband is currently on a tourist visa and he has tried to change his visa to a Non O (dependent) on the basis he's married to me, a foreigner working and living in Thailand, with a Non-B visa and a work permit. Unfortunately, although his visa had plenty of time left, his application was turned down by the local immigration office  as they said  it is not possible to change the existing visa there, and he was also told he has to apply abroad and then he will be able to get an extension there later on. Now, we need to find out what to do next, where to go and what documents are required. It seems that the policy for this type of Visa varies according to the immigration office .I've been reading about different immigration office: Chaeng Wattana, Penang or Vientiane ? Any advise please ?

YES you need to go outside Thailand and buy him a Non Immigrant O before you can proceed. Immigration is correct... You will soon have better advise here, so just hold on...

Over the years we have seen the system change so that the issueance of non-Immigrant visas in Bangkok has been devolved to Immigration officers and has become routine. This could work in your favour provided the standard application form allows for a dependant to apply so as a first step, apply at Cheang Wattana.

Do you have a entry from a non-b visa or a extension of stay issued by immigration?

In order for your husband  to do the change to a non immigrant visa you must be on an extension of stay.

Hello, I'm in Phetchaburi, the local immigration office said we've to go abroad. I have an extension of stay NON-B issued by immigration valid until 30th September and my husband's tourist visa will expire on 8th January. Do you have a contact number of Chaeng Wattana that we can call to ask information, so we know whether they can issue the Non-O visa there or we have to go out of the country? Also, I need to find out about all the required documents so I can request from my school next week asap.We've got a contact number from the internet, it rings but no answer.

This will be interesting.. UJoe have told us in the past, that in case like this, you need to have an Non Immigrant O in order to be able to apply for an extension of stay based on dependant.

Non Immigrant O in this case is NOT issued inside Thailand...You need to go out... easy peasy..

Since you are working here as a teacher your husband can apply for a change of visa status to obtain a non immigrant visa (category O) entry.

He will need at least 15 days remaining on his 60 day entry or the 30 day extension of it.

In this case it is possible. For a person whose spouse in on a retirement extension it is not possible.

Thank you very much for your reply and information. I do not understand why our local immigration office told us we had to leave the country when we qualify for change of visa within the country. For this, now we're running out of time, and 15days prior to tourist visa expiry date is on Monday 25th, and we do not have all the documents to present, that is the letters from my school. Is it calling Chaeng Wattana to explain this a lost cause at this stage? Shall we just contact Vientiane in Laos to double check the required documents for that immigration office and make arrangements to go there?  Or will the documents be the same as Chaeng Wattana ? By doing so, my school should have enough time to get all the documents ready. Please advise your comments, please. Thank you.

In the past only Chaeng Wattana was and a few other offices could do it. In the past few months immigration has directed that all offices can do it but many still say they cannot accept applications for a non immigrant visa. You could try again at the local office and show them the list of documents. 

If he has not done a 30 day extension of his 60 day entry he could apply for one to get the change done.

Your husband will only need your marriage certificate, copies of your passport photo page and extension of stay stamp to apply for a single entry non-o at the embassy in Vientiane.

Our local office were adamant they cannot do it, even though they converted my tourist visa into a non-b not too long ago....perhaps because they have never done it and they do not really want to do it or try ....they just told me to go to Malaysia or Singapore without telling me what documents are required. Can I ask: why fewer documents in Vientiane ?

They may not be aware it is possible. As I wrote before show them the list of requirements (switch to Thai at the top of the webpage they are on).

Immigration adds a lot of required documents since it is a special type of application for them.

Embassies and consulates just ask for the basic requirements which is proof of relationship and the reason for doing it.

Many thanks for your valuable information ! Do you have a number for Chaeng Wattana I can call ? I'm pretty sure the local office would say that now they cannot change the visa as there are fewer than 15days left...in that case, we could try calling Chaeng Wattana and explain what happened.... Or even, ask the administrator of my school to call the local office and speak to them...

You could ask to the schools administration to contact the local office.

You could contact immigration division 3 since your local office is under them.

Might I suggest firstly your husband applies for a 30 day extension at your local Immigration office next week.

This will extend his permission to stay until February and allow more time to resolve your issues.

He has already extended by 30days after 60days, so I believe he cannot do that at the immigration office anymore, but  he would have to do a visa run or leave the country and fly back in. In the case, we might just go to Vientiane...

Hello ! Update : he has been to Laos and he managed to get a three month NON-O dependant visa, which it'll expire on the 09th April. I assume he can go to the local immigration office to extend the visa ( the officer had already told me that). Do you know if the required documents are the same as the ones used to apply in Laos ? Also, how soon can he extend the visa ( 21days before expiry date or earlier ?). Trying to finalise his visa promptly. Thanks for your answers.

He can apply for the extension during the last 30 days of the 90 day entry from the visa.

To apply for the extension varies from office to office. I suggest you contact immigration to find out what they require. The will probably want proof you are still working from your employer.

iam foreigner working in NON B visa in thailand. i brought my wife in dependent visa and got extend upto 2019 Aug. she got job in a company but she need work visa. what should need to be done.
