Happy New Year everyone -

I recently travelled out of the country with my Thai wife and son, who has dual Thai-Canadian citizenship and holds a Canadian passport, though does not yet have a Thai one. This was our first trip out of the country with him. 

 

On departure at Don Mueang, immigration asked us to see my son's birth certificate and wrote in Thai in his Canadian passport that he was a Thai citizen. Upon our return, he was stamped in as any foreign tourist would be -- 30 day visa upon arrival. I realize that I made a mistake in familiarizing myself with the rules and making sure he had both passports when he traveled. 

 

My question is: What do I do now? He is a Thai citizen with a Canadian passport that contains a visa that is set to expire. I haven't found anything online about this issue and would appreciate any advice.

He can get one year extension of stay at immigration for 1900 as a Thai national. 

Other option are leaving and returning on Thai passport. 

 

Children under 15 are not subject to overstay fine but gets a overstay stamp in the passport.

That´s of course 2 alternatives. I am not 100% sure, but isn´t it possible to get a Thai passport for the child in Thailand, and clear the issue at an Immigration office after the passport is issued? In that case also don´t have to pay 1900 Bath?

No that’s not possible.

Reading your post I thought you really meant "departure from DM",,, But in fact you meant "arrivel TO DM"

 

As having a thai citizenship, yes you can buy your son a thai passport while in Thailand. But it doesn´t help him in any way now. But for the next trip it will be of help. You than leave Canada on a canadian passport, arrive to Thailand with the thai one, after holiday leave Thailand again with the thai one, and finally arrive Canada with the canadian passport.

Ok, thanks, everyone for your input. We'll try to clear this up at immigration tomorrow - suppose the 1,900 baht extension of stay and doing things correctly next time with both passports is our best option. Cheers.

If you are planning on taking him out of the country again within the next year you could get a single (1,000 baht) or multiple (3,800 baht) re-entry permit at the same time you get the 1 year extension of stay. That way he can keep using the Canadian passport during that year, and your sons 1 year permit to stay will be maintained by the re-entry permit. You can renew the 1 year extension each year too if you prefer not to get a Thai passport.

 

Also, note that if your son gets the 1 year extension of stay he will have to make 90 day reports.

Ended up getting just 30 days because they wanted the tabien baan, which we didn't have with us. Quite a miserable piece of work at Chaengwattana, who offered no helpful advice whatsoever. We'll return there for the year extension. Thanks for the reminder about the 90-day reporting. Hadn't thought of that given that he's a Thai citizen, but guess we'll have to do this until we sort this mess out - glad it can be done online.
