Building is a long time
Completed project

Condo is paid unfortunately

Developer has been unable
to transfer the tittles ( Mortgages  )

Would it be possible to ask Refund ?
I am looking for
Advices / Lawyers

Read your contract. The developer has an expected completion/transfer date which can be extended for unforeseen circumstances. If the developer has no rational excuse  then see a lawyer. Talk to other buyers too.

Thanks for all replies

It was a good advice looking at owners experiences ,

many google posts on Emerald are closed though

I believe that  Building is a different developer

- Few options members pointed

Rebuying tittles mortgages from bank .

Little costly

Efficient  Lawyer for refund

Details  welcome , I can't find any .

And looks alike years of procedures in Thailand

Consumer protection offices

not much results so far

The Contract does not mention  delivery dates !

Project was finished a very long time ago ,

sold as ready to move in .

I never hold keys / moved in , as no tittle

no contact with others buyers / owners

Glad to chat and share with others people

who have experienced ,

or are now going through the same issues

I've seen this problem before, it's something related to bank financing where the bank still has ownership because the construction loans are not fully paid, sorry I can't be more precise but it's along those lines.

Thanks this is very a clear explanation

if that s the case , it makes sense ?

Condo units sales amount  / Construction costs , loan fees

That shouldn't show a negative balance or debts ,

unless using NASA research construction materials

developer may also find a way to pay out mortgages

Has anyone managed refunds in others projects ?

what are best legals actions to pressure

(completed projets ) Developers

onto refunds .

Are owners of Ltd s / Management

Usually the real owners

or the Developer himself

in Thailand ?

anyone who has experienced or in similar issues

Taking lawyers , going to court and all the process .

Thanks Pm me for a chat

Sorry to hear of your problems. You may have to kiss your money goodbye. It might be just a money laundering scam like mafia/local councils planning permission frauds as with empty unused shopping malls in the USA. There is no law here no rule of law no common law no napolionic law.  Its a third world country with the trappings of a western veneer.  Its all in their history books. Sorry cant be more positive but something similar happened to me in Uk. Just had to write off 20k BPS. Move on. Good luck.
