I'm sure the answer is, "yes" and luckily school doesn't start back up until the 15th...

OK, took forever to get paperwork to get a work-permit extension.  got it.  and the last 90-day check-in at immigration was last month......SO I forgot to go to Immigration on the stamp on my passport (3 or 4 days ago).  I don't even know what paperwork they need.....school is closed.

I guess I thought after the WP stamp I was good until the next 90-day check-in.....BUT I realized I'm pretty sure I'm wrong.

How bad is this?

I guess worst case, i make a border run, WP expires, then go to Laos to get a Non-O B again and pay the overstay and .......

What do you mean with "90-day check-in"? If you refer to the submission of a form, indicating the form number will make for an easy understanding.

I worked for a school for one year, had work permit and I needed to go to Immigration every 90 days.  They staple a form on my passport every 90-days.  They then put a stamp to remind me when to go back.

I stayed with the school for another year and got a new stamp on my WP for another year, but didn't go back to Immigration when my contract expired.  a few days ago.

I am finding the post by puukao confusing. If he is referring to the TM47 90-day confirmation of address then I think he is under a misapprehension that his permission to stay is cancelled. This is not the case. He may however be liable to a fine.

It was only for my address......

So now I must go tomorrow and see what happens....

I'm on overstay and i'm guessing I'll have to leave and then lose my work permit and do the entire process over.

even if i lose it all, job and everything and go work in another country........it's OK....  i'm not that worried.  but this was my mistake.

Puukao's second post informs us "his contract has expired". If so, has the school cancelled the work permit as they should when employment comes to an end? Many employers don't do this. If nobody has done this, then the permission to stay will remain valid.

visa expired on April 30th.

just not sure how much they can do at the immigration office, or i have to leave the country.

Posted

There was a stamp in my passport at the same time my old contract ended.

I took care of getting the work permit extension and a new stamp in my WP book, but not in my passport.

i'm sure i'll have to go on a million trips everything and pay a lot to fix this mess.....

Now puukao tells us he has "a new contract and work permit extension". Thus he is not on overstay. It seems every post adds new information contradicting the previous post. I remain confused.

I'm confused too... sorry.  5555.

YES, I got a new contract and work permit extension

BUT I didn't go to Immigration.... I have to go to Immigration, right?

I got the WP extension last week, but my stamp in my passport says April 30, 2018.

Stamp on my WP says April 30, 2019.

make sense?  55555

Puukao,

What is the last stamp permission to stay stamp in your passport? e.g. admitted until xx/xxx/xxxx

And when was it stamped?

Posted

Okay, you are not on overstay. You may receive a fine of 2000 Baht for not doing your TM47 90 day address notification.

edit : Hang on cancel that. Did the school not process your extension of stay at immigration also? Almost always your employer does this.

Posted

so you don't think they will cancel my work permit?  and make me leave the country?  and get a new Non-O B?  55555

Posted

Puukao- can you  please be clearer?  I'm as confused as hell.

EDIT- Look in your passport for something that says ""extension of stay permitted up to" with a manual stamp.

I am mystified as to why the school seems to have ignored your permission to stay (having done the hard work to get you a Work Permit).

If your last permission to stay expired 30 April 2018, then somebody (the school) needs to get down immigration and extend your permission to stay pronto. Normally you cannot do this yourself due to the complexity of the paperwork for an extension due to a Work Permit.

nobody was at the school all week.....Monday at the earliest.

Yea, i should have asked them about immigration.  odds of them being proactive....zero.

Briggsy, you sure I'm not on overstay?  Just pay a fine and have the school help me next week with this?

The sad part is probably 99% of all foreign teachers never got a new contract....i only know of one other person in the last 10 years (so i've been told).

If your last permission to stay expired 30 April 2018, then yes you are on overstay. I thought you had a permission to stay stamp till 30 April 2019 but you don't so you appear to be on overstay. However, if the school get their backside into gear they may be able to smooth it over. The longer it is left, the less the chance.

I cannot understand why they didn't deal with the permission to stay. From what you have said, they did it last year. Why just ignore it this year? I am confused by the information you have provided.

few things....  last year was my first year with the school and i had an agent who helped.

yea, i figured i was on overstay.

nobody is at the school now...  it's going be a problem.

i'm just not sure how big a problem it will be...

sure, the school will call Monday.  but tomorrow is not monday......

OK, so i'm on overstay...

Will this nullify my work permit?

Or can i stay in Thailand without leaving and doing the entire process over?

No, it won't nullify the work permit.

Even though you are on overstay, I would hang on till Monday and see if it can be sorted out without you leaving the country. Somebody (the school or an agent) will have to sort it out for you. If the school says it can't be done, then you would need to get the documents from the school to go to Laos to get a new non-imm B visa anyway.

Interesting.

So basically I lost my WP unless the school can pull some strings...

worst case I go to Laos next week.....  and this mistake will be about 15,000 baht.

pay WP twice...6000.   overstay....3000 or more.  and trip to Laos and pay Non-O B.

funny how life works....55555

Puukao- Your extension to stay, your contract, your ninety day notification, and your work permit are all different although they are connected.  It does sound like your extension to stay has expired which is not good news.  Try going into the school to see if you can raise anyone to help you before it opens again.

EDIT: There is a reasonable chance that you can hang on to your wp if you can fix your visa issues in short order.

I don't think you have lost your WP.

I have worked for some real shoddy employers here. But, on no occasion, did they process a WP and then fail to process the second step the permission to stay (lasting a year). I am really confused as to what happened to you. Why did they not process the permission to stay at immigration? Can you shed any light on this?

Immigration is like 1.5 hours north.  the place for the WP is like 5 minutes away...

My WP was finished the day before school finished, and then everyone went on vacation pretty far away.  I even went on vacation for a few days...

why they never talked about it to me...who knows....

but it never came up, and we just dealt with the WP.

i told them i wanted to do this months ago, and they wanted to wait until the last day.  i guess they have no experience with this....555555
