I understand that the person registered on a property's Tabian Baan is supposed to register any foreigners staying at that property with 24 hours and that this is now being more closely enforced. I also understand that the foreigner can get a Power of Attorney form signed by the registered person which allows the foreigner to register themselves.  My question is, is this one of those one time, time limited Power of Attorney's?  The registered person for my house lives 2.5 hours away and I don't want to be doing that journey every time I arrive. I guess if it is a one time only form that I could get a batch of them signed which would last me a while but its still a pain.

 

I read somewhere that the housebook keeper could sign up for an online version of this which would mean that all I need is their log in details and the problem would be solved.......but I also read that the online registration website often doesn't work - is that still the case?

 

Also, is this registration still a requirement if I hold a usufruct lease? Thinking logically, I should be able to register myself if I hold a usufruct but that's thinking logically not thinking Thai bureaucracy.

It all depends on your local immigration office, they can all have different rules. Your safest bet would be to just ask them what they want

Your asking about filing a TM30.

Lots of topics on this subject.

Not every IO requests a new TM30 to be filed when re-enter the Kingdom, so you firstly need to check the requirements of your IO.

 

It is not necessarily the house owner, or the person registered on the Tabien Baan who is responsible for filing the TM30.

Section 38 and section 4 of the Immigration Act defines those responsible.

The person first registered in the blue Tabien Baan is registered as the 'House Master', but is not necessarily the owner.

As a tenant, you are also the 'possessor' of the residence.

 

Section 38 : The house – master , the owner or the possessor of the residence , or the hotel manager
where the alien , receiving permission to stay temporary in the Kingdom has stayed , must notify the
competent official of the Immigration Office located in the same area with that hours , dwelling place or
hotel, within 24 hours from the time of arrival of the alien concerned.

 

Section 4. “ House Master ” means any persons who is the chief possessor of a house , whether in the capacity of
owner , tenant , or in any other capacity whatsoever , in accordance with the law on people act.

 

For what it's worth I've always filed the TM30 myself, in 3 different Provinces, exceeding 20+ submissions.

I've always supplied signed copies of the Blue Tabien Baan for the residence and the ID card of the 'House Master'.

Never had an issue or problem, accepted by the IO's without question.

Thanks for that, I think the best way is to visit Korat Immigration armed with a signed copies of the Tabien Baan and the registered owner's ID + my usufruct and a big smile and see what they say.  I'll have to play it very carefully though as there is one officer there that just loves making things difficult for foreigners.  If the matter comes to her attention I have no doubt that she'll want the owner to come down personally every time.

The online registration system for filing TM30's is predominately for commercial businesses, hotels, guest houses and is in Thai only.

 

That said Immigration have registered some individuals who frequently exit/enter Thailand for practical reasons.

You need a username and password to log in, which Immigration set up in the first place.
