Authorising Lawyer To Sign Contract

Featured Replies

I just made a deposit for to buy a condo and the developer told me i have to sign the S&P agreement in 2 weeks time. And they can't defer the contract signing date. This means I have to make another trip to Bangkok, which is quite a hassle, especially since it coincides with Chinese New Year celebrations. My lawyer said it's not necessary for me to sign the contract personally as I could appoint the power of attorney. But I feel that it's better if I'm there personally so I could at least sit down face-to-face with the people to go through the terms and conditions. What's the advice from you guys?

Do you trust your lawyer?

Even though I was in Bangkok when contracts were exchanged, I had the lawyer sign the S&P on my behalf executed by a PoA. Firstly, he has done conveyancing many times, I haven't, and secondly it was mostly in Thai. If you have specific questions, then give him a list.

I personally would never ever ever give a Thai lawyer Power of Attourney. Control of lawyers in Thailand is far too weak and haphazard.

I have to agree with Guesthouse here. If you choose to ignore this good advice, at least make sure it's a Specific POA and not a General POA.

Thanks guys. I think you all have affirmed my concerns. I personally don't trust anyone entirely including lawyers. That's especially so when this involves a major transaction in a foreign country. Will make the trip down to BKK :o
