I am an American citizen who have been married to a Thai national threw the Thai courts with the help of a lawyer to make "legal" here and the USA. My question is now I live in Thailand and have not been to the USA since becoming married, and my question is now after a little over 3 years the wife would like to be able to go back with me on occasions to visit and meet family. What and how should we go about this and yes we have everything translated from Thai to English when we got married. There are no plans to live in the US but she or we would like to visit from time to time. Thank you for any help or direction we need to go by.

Thank you, now, if she wanted to become a citizen then we would need to reside in the US and use the K-3 or K-1 form?

She would have to by doing a I-130 petition and exc to get permanent residency before applying for citizenship.

A good starting point is to check the info here. https://th.usembassy.gov/visas/

To get a visitors visa (non immigrant visa) a lot would depend upon your status here. If on long stay extension or visa it will help a lot.

Thank you as I originally posted she would like to gain citizenship but we will reside and stay in Thailand if that makes sense as we have home, car etc. already here and I have no intention of living in the USA it's just to costly for my income as I am on Disability and can not work. We just want to now after 3+ years of being married would like to make USA a second home with family as far as work for her that is another separate issue. Where would I start this paperwork? US Embassy, Thai Embassy, or in the USA?

That scenario just isn't possible.

To gain citizenship you would have to have petitioned for an immigrant visa as joe righty states va an I-130. Citizenship can then be applied for after 5 years of holding permanent residency, AKA Green card holder.

The rub for you however that there are rules on how long you can spend outside the country, without losing status.

6 months rings a bell, but if she spends more than a year, even if you apply for a re-entry permit to keep the greencard alive, the clock towards citizenship will stop while she's outside the country.

If you have no intention of going home anytime soon, I'd personally forget any citizenship aspirations, and just go for a 10 year tourist visa for those trips back home

Thank you for this information as I do not want to waste money as I went over the fee list and there are quite a few and some are costly even on my income lol. Will look into that and the cost Thank you
