Junta, government to discuss revoking certain orders

The junta and the government are scheduled to meet on Tuesday to discuss the revocation of orders and announcements originally issued by the junta but which are no longer considered necessary, Deputy Prime Minister Wissanu Kreau-ngam said on Monday.

 

Some of these were issued in 2014, Wissanu said.

 

Prime Minister Prayut Chan-o-cha, who is also the junta chief, said the junta and the government had not officially met for long time and that with the Royal Coronation now over, it was a good time to hold this discussion.

 

They will consider the use of absolute power under Article 44 to abolish those announcements and orders, Wissanu said.

 

In fact, a junta meeting held on April 30 already took decisions on certain issues but Deputy Prime Minister Chatchai Salikalaya asked that a fisheries-related order be revoked with some conditions. This will be reconsidered on Tuesday.

A commission ought to be set up to review and analyse whether Article 44 of the Interim Constitution 2014 is dictatorial in nature and whether it has been indiscriminately used and allowed absolute power solely consolidated into the Head of the NCPO. The commission should decide whether to banish the use of Article 44 by future coup leaders with bad intention to misuse their powers indiscriminately. Article 44 has remained mysterious among the public and has been used as a tool by Prayut like his order to nominate the board of the NACC and transfer of EC previous President. NACC and EC are agencies by which their conducts have been controversial and questionable.

Article 44 should be abolished directly after. But it will probably be kept for when the newly picked PM goes to office.

They will NEVER relinquish Article 44 - or its equivalent, under a different name; such sweeping powers have proven too addictive to be tossed out due to such an inconsequential thing as an 'election'. And in any case, we all know that the militarists have 'won' that 'election'.

So: Article 44 (or a new incarnation of it, disguised with some silly new name or classification) will live on and thrive.

 

Thank God the junta held the liberating 'election' - and that the Thais never boycotted it (as many of us - ahem - were urging for months on end!).

If they can remember what they were.

I seem to recall about 12 months ago there was some discussion that the government hadn't properly maintained a register of the use of Article 44 and therefore no one including the PM had a record or knew how many times it had been used or the reasons why. It would come as no surprise if that were found to be true.

Read somewhere that almost 300 times that A44 were used since May 2014 or about 70 each year or about 6 each month. That's a lot of throwing his weight around with no oversight. Kind of a definition for dictatorial or abuse of power.

So, if the Big Boss in Gov't, is also the CEO of what he decares is a separate enterprise; he'll have to declare the having Interests in a going business, all the while sitting as a member of Gov't.

Maybe they'll justreplace it with an app that comes with an autovote yes! -option (should certain conditions be met) for all the senators and rigged majority of the parliament of course. They could even call it Application 44, so they can keep on using a familiar abbreviation.

The doctoral powers provided by 44 will likely remain in place but the rewards for those larger groups of the public supporting the junta in the recent election will be revoked as their support is no longer needed to provide cover for the theft of the election.
