last week i went CW to convert my 30 days visa exemption to a non immigrant o based on retirement .

I transfered the 800000 THB to my KK account in Thailand before. IO checked my documenst and everything was fine.

She told me i can pick up my visa at the 21th of june in CW

 

Today another IO called me to make an appointment for tomorrow. They want check if i really living at my address, and some Thai person

has to confirm this and sign a document. She told me also to prepare my passport and my updated bankbook again.

This point makes me now a bit worry. After i went to CW and showed the bankbook with 800000 THB i had to pay rent and electricity.

So my balance is now under 800.000 THB , exactly 798.000 THB

can this be a problem now? I didnt know i had to show my bankbook again. Is there a rule how long the money has to be in account after applying for a non immigrant O

visa?

  • You no longer qualify for the conversion - should never remove funds prior to actually receiving visa or extension of stay.  If they will not allow it may be easier to visit a Consulate outside Thaila

  • Most likely you have done your dash. Put 2k into to account and say you made a mistake. You might get lucky.

You no longer qualify for the conversion - should never remove funds prior to actually receiving visa or extension of stay.  If they will not allow it may be easier to visit a Consulate outside Thailand to obtain the non immigrant O visa once above 800k again.  It will need to be at or above 800k for the two months prior to application for extension of stay and under new rules remain there for the next 3 months.

Yes, this i know and this the IO told me also. But i apply now for a non immigrant O, and not an extension. I dont want to do an extension, i  just want the 90 days non immigrant O visa, as i go back to germany in around two month.

You never intended to extend for retirement?

Maybe you can start over again if they deny you. Just put back enough money in account and reapply.

I would not recommend trying again after above statement that he did not intend to extend.

no, like i wrote. last week friday the 7th i apply  to convert my 30 days visa exemption to a non immigrant o based on retirement.

I showed my bankbook with the 800000 THB, bank letter and so on. All was fine. IO told me i can pick up my visa in two weeks, at the 21th. Nobody told me someone will come and will check my bankbook again. They only told me IO will come to check my place where i life. I have no intention for an extension here in thailand. I only want the 90 days as i go back to germany soon.

 

I cant also apply again now, as there must be remaining 15 days of my visa exemption, which is now not the case anymore

i dont understand what you mean. Is there a rule i have to make an extension after i apply for a non immigrat O visa?

 

Even if i change my mind now and will apply for an extension. Like you wrote " 800k for the two months prior to application for extension of stay " then i had still had time to refill my account as the non o is valid 90 days.

If they don't....how many visa exempt by border have you done in 2019. You are allowed 2 visa exempt entries at border. Your fall back plan could be do border runs. 

AFAIK that conversion is special and only made for purpose of filing a retirement extension of stay (to make it easier for those already in country).  It seems you just want the 90 day stay, which likely would not be questioned if obtained from a Consulate.  If conversion not allowed perhaps normal extension and a visa run would serve your needs?

did already two border runs this year, and also two extensions. I just turned 50, so eveything was well planed, except my stupidness ????

Understand that another might be suspect but if you use the funds in account to obtain that non immigrant O visa from a Consulate do not believe your entry would be questioned.

Yes!....3 months...after that can only take out upto 400,000 Bt.

You can only get a Non Imm Visa in Thailand as part of applying for a 12 month extension.

If you have no intention of applying for the extension they are not going to be too impressed with you.

Nice of them to visit. Maybe they can extend the service for 90 day reports and TM 30 reports??? ????????

You have to leave 400k in account you can take anything else out.

Better clean up your bedroom most likely they have to inspect that also..

Then why bother with Non-O??? Much simpler for to just extend the 30 exempt entry and do a visa run (in either order. Really no point to making them (and you) do more work.

There is no limit on border runs by air or extensions. The only limit is 2 border runs by land a year - assuming that's what you mean.

True, but it implies he has been living here on visa exempt entries. An attempt to do an in/out by air for a further visa exempt entry carries a significant risk of a denied entry. Immigration officials even have the official power to deny a visa exempt entry in this situation (pursuant to publicly announced limitations on visa exempt entry starting in 2014).

The obvious next move is to visit an immigration office outside Thailand to get a visa of some description, returning to Thailand via a land crossing. If returning home in two months, a tourist visa would suffice.

Yes.

 

After the new regulations you'll need 800k baht two month prior to you application for extension of stay based on retirement, and for three month after your extension of stay has been granted. Thereafter you'll need a minimum of 400k baht in the account, until you top up to 800k baht again, two month before your next application for extension of stay based on retirement.

 

Some IO might still ask for three month maturing time of the 800k when renewing extension of stay.

 

Preferably make a separate bank account for the fund deposit for extension of stay, its much easier for both the IO and you. You could make two accounts, where one is a 12-month fixed for 400k baht, for best interest, and one is for example a 3-month fixed account for the 400k baht to up up to 800k baht, if you need to take money out. You can always withdraw the interests.

What is your plan? The issuance of a Non-Imm ‘O’ visa has only been an ‘off the shelve’ purchase recently, it used to be difficult to obtain and was not just another way for an over 50year old to extend for a few months.  Do your future plans include returning to Thailand for more than 90 days?

managment office who knows me, he was not really happy about that, as he had to sign a form, and give

a copy of his ID. IO told me staff from other condo management offices often will not sign any forms,

as they dont know what it is about. I asked also if they visit every foreiniger who apply for a

non immigrant o visa, and IO confirmed that they do this now since last year with every foreinger

and they are very busy. 

 

About the money. They only ceck date when i applied for visa, and for today. As i filled up to 800 K it

was no problem. IO told me now i should not touch the money untill i will apply for extension as money

has to stay in account two month prior to applying.

No

He did not apply for an extension based upon retirement. He ha applied for a 90 day non immigrant visa (category O) entry at immigration based upon qualifying for a extension based upon retirement. The checks are are required by the officer that approves the visa application.

Seems like it, but apparently not every year.
I had a extension-of-stay-based-on-retirement home visit a couple of years back – really a disaster, coming too early morning (for me) and taking photos of me holding my passport with open picture page, in morning hair and with only a towel around my waist, together with a ???? police officer in front of my house with the house number visible...???? – the two otherwise very polite police officers had a long list with additional expats to check that day, they kindly showed it me, and asked me to sign the line with my name...????

 

There has been a number of posts, and at least one forum-thread, about the subject.

I thought you had to maintain the Thb 800 k for three months after the visa approval date. Might be a problem.
