Hi to everyone!

 

I have a question about TM30. Does immigration at the airports like Suvarnabhumi really enforce TM30 when people is going out of Thailand? A friend of mine is receiving family from Europe and they are staying at his condo during 7 days. Does he really need to sign TM30 for them?

If the friends are putting his Condo address on their TM6, then yes he should.

The friends from Europe staying for 7 days at the condo are arriving as tourists on 30 days exempt or tourist visa. They fill out the address on TM6 form on arrival at airport. TM30 is not necessary unless on Non-Imm visa, not for normal tourists. If they spend anytime in hotels, hotels will notify imm of tourists staying there automatically. So no need to do anything about TM30 report.

I had an interesting experience on departure earlier this year. I had arrived early morning and indicated transit on my arrival card. I was leaving late that same evening.

 

On departure the immigration officer was quite firm in asking where I had visited during my stay. He said I must have been to chiangmai or phuket during my stay etc. There was obviously no TM30 report on his computer.

 

I replied politely in Thai that I was transit and had only arrived that morning. Realising his mistake he quickly processed my departure and handed back my passport.

The responsibility for the TM.30 report is that of the condo owner, not the visitors staying at his condo. Technically, the condo owner is responsible for reporting their stay within 24 hours as would be hotels if that was where they were staying rather than in the person's condo. 

 

That said, unless the visitors have some reason to visit Immigration for a service, such as extending their 30 day stay for another 30 days, then making the report as they say is "up to you."   Immigration will never know or have reason to question the condo owner about the omission (at the ports of exit, Immigration does not bother to check the TM.30 or 90 day reporting databases (who knows, they may not even be set up to access those databases).

Here's a question, my condo is in my name only. Do I have to do TM30 for my wife and child who are not Thai and follow my Non-Imm visa whether B or O.

TBH,if I hadn’t read this forum, I’d never have heard of it.

 

At what point is it checked?  90 day report?

It can be checked then.  At my last 90 day, the IO was explaining the TM30 requirements to the person next to me.

It is also possible that if you were to stay in a hotel for a while and they filled out one for that address.

I know a chap in Pattaya and I just asked him and he'd never heard of it either.

 

He uses an agent for his visa, so I guess the agent takes care of/removes any TM30 issues??

 

He's moved several timesd since he came to Thailand about four years ago.

I think you are wrong, BUT, if the friends have no reason to attend immigration, and they should not, there is no likelihood of them being asked wrt a TM30. So no need to bother. 

Let us hope the condo is not raided!

In a nutshell, yes, basically all foreigners not in hotel type accommodation should have a TM30 receipt. but it is all a bit hit and miss.

A friend of mine who normally does 5 months came in Nov for the first time since he got married. After a couple of weeks he rang me up and asked if it was any easier now he was married. He had come on a SE non o and I said all he had to do was go to immigration and get a 60 day extension. As he lives with his wife I warned him that he ought to go to immigration and ask about the TM30 in case it became an issue when doing the extension. He went along to the immigration at Nong Khai and the IO said it should have done as soon as he arrived but not to worry, gave him the form and told him to bring it when he did the extension.

The immigration office I use say it is only necessary in you change address, the TM30 receipt in my passport is just on 5 years old, done several extensions and trips out of Thailand in that time.
