Thai wife of seriously ill British man threatened with deportation as husband ‘fears for his life’

Yes, I'm afraid that the UKVI/Border Force, not the FCO as one member thinks, have seemed to show no  compassion in this case.

Yarls Wood Immigration Removal Centre is near Bedford and the local MP, Alistair Burt, until recently a Foreign Office Minister, takes a great deal of interest in Yarls Wood and those detained in it, I suspect it was he that challenged this ladies removal, and that's why it's been put on hold.
I'm afraid that Enforcement Teams go for soft targets in order to meet their targets, yes, this lady had overstayed her visa, but hadn't gone under the radar, she was trying to extend the stay of her visit visa, which isn't strictly allowed, but it can be done in very limited circumstances, and I believe her case isn't one of them.
I'm also suprised this lady has been detained, she's not a flight risk and whilst one of the main critera for detention is that she's removable, which she is, there is the option of reporting to the UKBA Officials at LHR, I'm wondering if she may have previously failed to report, in which case her detention would be lawful.

It's not clear if the husband has returned to the UK on a permanent basis, in which case he'd be allowed to use the NHS for free, or was simply visiting, in which case he's reliant on insurance, either way, unless he has insurance in Thailand, he wouldn't be covered here. 

I'm afraid that whilst this lady may have been subjected to the letter of the law, it beggars belief that she should be required to travel back to Thailand to apply for another visa.
I wish them both well.

Under the circumstances, she should obviously be allowed to stay in the UK to look after her husband but would a foreigner on a tourist visa in Thailand be allowed the same?

I believe the subject is about a Thai wife being deported from England. Start a different thread if you are that interested.

Exactly! The UK has become pathetic nanny State, afraid of doing anything that isn't written in triplicate in their rule book. Not one of those supposedly "running the country" has any sort of set of balls, it has become an embarrassment of a nation, pandering and cowering in political correctness in the hope of never so much as slightly offending any minority or misfit.

The sheer lack of humanity is something I can't get over, how bloody terrible. 

It is to be hoped they can remain even if it is on the understanding that she leaves if and when he passes away.

I think that English immigration is getting more like Thai immigration every day. Difference is Thai officialdom does not like foreigners whereas English immigration does not like the English.

Wifes gets indefinite leave to remain for any EU citizen. Tho u need to apply for it.

A little compassion is all it would take but the UK seems void of such things, just look how the treat people in unemployment centers, look how badly the ill get treated when trying to claim incapacity benefit. For it to change you would need a change of government but seems voting folk like austerity and the brexit farce now led by Boris the unwise.

In my opinion they knew that he needed Dialysis and that is the reason for the visit this time because it is free here.  Stage 5 CKD does not suddenly appear, I have stage 4 and have known for 3 years and have regular check ups.

What I think they should have done is apply for Discretionary Leave to Remain which is often granted in similar circumstances.

You are right. They could have also had an appointment in the UK and explained their circumstances to an Immigration lawyer.

 

Once furnishing the lawyer with the correct documentation, the lady would have been given leave to stay and it would have been kicked around the system for two or three years, whilst they sorted their affairs out. It isn't even overly time consuming to do this.

Does anyone know why they are being threatened with deportation? I didn’t read the whole back story on this. But the article says they’re threatening to deport his wife as well who’s a “Thailand native” according to the article so that tells me that as usual this isn’t the whole story because they can’t deport his wife as well if she’s a Thai citizen so obviously she must be a British passport holder she must have obtained her British citizenship just like most of my wife’s Thai friends back in the states. That’s if I read it right at least and if they really are threatening to deport the wife as well then I’m sure she’s no longer a Thai citizen. Doesn’t make sense so this is obviously not the whole story on yet another weird one.

 

I do hope everything works out for them though I really do because bad things can happen to good people sometimes unfortunately.

 

 

 

Hope they are ok - should write to their local MP and discuss the situation I'm sure he would help as immigration is not there to ruin peoples lives and he has a very valid case

The UK FO tries to send one of its seriously ill citizens to receive treatment in Thailand? Wow....

If America can let over 12 million illegal stay in Amsrica then the UK who also has many illegals in its country, surely they can let one honest lady stay and take care of her husband if not then Thailand should kick all the people from the UK out of Thailand
