Oddly, some people believe this is still possible.

Meanwhile, in Ireland, their govt has to either approve a deal that involves a hard border and be complicit in putting it there or reject it with the same consequences of a hard border but politically able to keep there hands cleaner from their own voters perception.

Boris Johnson could be ordered by a Scottish judge to delay Brexit after pro-remain campaigners secured an emergency court hearing for this Friday.

The campaigners have asked the court of session in Edinburgh to issue an injunction, or interdict, which would force the prime minister to ask the EU for an extension to article 50 if he fails to get a new deal passed at Westminster by 19 October.

 

 

And the games begin. Let's see how much substance Boris' lawyers really have, and whether their plan to get this transferred to the EU courts based on supremacy of EU law actually works.  As I understand the conjecture, they are going to argue that the EU illegally negotiated a deal with a national parliament instead of a national government as the law required. If they are successful, it won't matter what the UK courts do.

 

Really not sure if a national injunction still has merit in the case where the argument is being heard by an EU court.

 

Anyone have knowledge of an esoteric area of EU law? What is going to happen?
