I am considering getting a Non-immigrant O visa in category B(working) from Los Angeles consulate.  I will be employed by a Thai family member's business.  He has about 150 Thai employees and has a growing need for IT assistance.  I am unclear about the meaning of the phrase in red in the 8th requirement shown below.  Do I get the work permit before applying for the visa?  

Documents Required of Non Immigrant category “B” (Working) from the website of the Royal Thai Consulate in Los Angeles:

  1. 1) Your Passport
  2. 2) One original visa application form completely filled out (black and blue ink only) and two photos
  3. 3) A copy of flight confirmation/reservation , showing going from US to Thailand (The name of the applicant must indicated clearly)
  4. 4) A copy of recent bank statement ($700 per person and $1,500 per family) 
  5. 5) For non-US citizen, a copy of permanent resident alien card or a copy of valid US visa with a letter proof of employment
  6. 6) Letter of invitation or acceptance from the concerned companies/ organizations
  7. 7) A copy of Work Permit issued by the Ministry of Labor and alien income tax or PorNgorDor 91 (only in the case where applicant has previously worked in Thailand)
  8. ???? Letter of approval from the Ministry of Labor. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labor Tel. 02-245-2745, or at the Provincial Employment Office in his or her respective province. More information is available at Department of Employment or www.doe.go.th (only applicant can’t submit item 7.)
  9. 9) Corporate documents of associated partners/companies in Thailand such as:
    •   Business registration and business license
    •   List of shareholders

That line in 8 means it is a or. If you do not have a work permit you need what is shown in 8.

If you are in Thailand now your employer would apply for the work permit and obtain a work permit application approval letter from the Labour Ministry. The after you arrive here on the non-b visa your work permit would be issued.

If not here they would do a work permit application using a WP3 form and send you the receipt for the application. Then after arriving you would have the work permit issued.
