Is it possible to get a Non-O based on child if you are pregnant? My husband and I are likely to divorce soon which means my Non-O based on marriage will end. However, I am pregnant and I'd like to stay in Thailand to raise the baby for the first few years. I am wondering if there's a way to obtain the visa while pregnant or will the child have to have been born already? Thanks!

If you are on a visa it will remain valid until it expires.

You cannot apply for a visa or extension of stay based upon being the parent of a Thai until they are born.

What is the validity expiry date of your present Non Imm O - marriage Visa?

Is it a Multi-entry Non Imm O - marriage Visa?

Or are you a 1-year extension of stay based on a 90-day Non Imm O - marriage Visa?

What is the expiry date of your present permission to stay?

>> A possible option for you could be to apply for a 1-year Multi-Entry Non Imm O - marriage Visa in Savannakhet or HCMC.  But this has to be done while you are still married.  When granted you can then squeeze 15 months out of that Multi-Entry Non Imm O Visa, another advantage being that it does not require any financials to be proven.

But whether that's indeed an option (and if so how to do it), depends on the answers of the questions above you can provide.

For Your safety and your unborn, Please talk to your obstetrician. On non-O, You will have to live Thailand every 90 days. It may not be a good idea if you are pregnant. If you are lucky and have friendly doctor doctor you will get paper work, stating that do to pregnancy your are unable to travel.  Trust No One! 

If child is born in Thailand and your husband is Thai national, the child automatically gains Thai nationality. You will be able to get non-O with out any problems.

Best to delay the divorce until after the child is born - you could just slow the process down so it doesn't complete until after the birth. Assuming your husband is the father ... and is willing to be named as such.

 

You cannot remarry until 9 months after the divorce, i think.

I am currently on a 3 month extension of stay right now (expires March 1, 2020) and will apply for my 1 year non-o based on marriage at the end of this month. I do not forsee any problems obtaining this as we have all paperwork in order. I will apply for multi-entry.

Timing is entirely up to you, but be aware that if you have a re-entry permit, you would first need to let expire your present permission to stay before you can apply for a new Multi-Entry Non Imm O - marriage Visa.
