Company owners banned from closing down business during emergency

Company owners are prohibited from shutting down their business while the emergency decree is in force, while staff are banned from going on strike, a Labour Ministry announcement published in the Royal Gazette website said.

 

 

The announcement is effective from May 8. It also ordered those owners who had closed their business before the announcement was published, to reopen their business. Likewise, employees who had struck work previously were ordered to return to work.

 

The announcement enjoined both employers and employees to work strictly in line with the Labour Relations Act. Disputes on labour issues will be adjudged by the labour relations committee.

    Surely this is over use of the Emergency Decree SOE powers what next? I mean if a business has no more cash how can they pay their staff is the government going to pay the salary? Could be a good

A good idea, but it comes 1-2 months too late. Business owners has long ago packed up, removed all inventory, and left the premises.

Could be a good excuse to extend SOE beyond Lock down using Emergency Decree to repair the economy?

Does it open up the possibility that laid off workers can sue their employers, such as hotel workers?

 

Will it force some businesses into bankruptcy, since the customer base for many businesses simply is not there?

Thaibev and Boon Rawd Brewery make product other than beer but I'd expect the  alcoholic beverages they manufacture for export would have been kept running though.

Is the government going to hand out bagfuls of cash to allow businesses to reopen, or just put business owners in jail for not opening due to having no funds to reopen?

all very sensible questions and since the press and public have no opportunity to ask the government anything and hold them to account they will all remain unanswered 

 

I wish there was a version of "splitting image" in Thailand there is so much material and they wouldn't have to make it up 

A case of nonsensical Government overreach. Unworkable.

Similar in the UK. If they re-opened car factories now:

1. They've almost certainly got a big inventory of new cars that need to be sold before producing more.
2. Who's gonna be in the market for a new car at this time?

Before the end of the year there should be some great deals on new cars.

So I am broke now...I cannot pay my employees, I cannot pay my rent anymore...But the government does not allow me to close down my business?

Exactly how are they going to make a business stay open that has gone broke from the virus shutdown and cannot pay staff - who are also banned from striking from work even with no wage from a company that is bust ?

This is Thailands first step in creating acceptance, by the Thai people, of the new future.

 

One that is yet to be "broken" to peoples worldwide.

 

Present measures are unsustainable.

 

No likelihood of a vaccine soon, possibly not for several years.

 

In the case of Thailand the real death tolls are going to become known eventually.

 

Naturally, in Thailand the people must be unilaterally compelled (the decree addicted Thai state knows no other way) to live "normally" and accept COVID deaths as they occur.

 

Different countries will present and manage the new reality differently, just as they have in the "outbreak" and "spread" stages.

 

The world is now heading towards the "it's part of life" stage.

So they want them to open and produce nothing than debts as there are no customers?

That is far beyond me. 

Or is this a goodwill plan from the government to avoid job loss because the government plans to pay all the running costs including wages,

because now i have in a thai bank a small amount that i need to get,

but just discovered the UNIONPAY ATM card does not work outside of thailand...

I had to think about this one for a while because it is illogical under the circumstances, but now I understand - take out a loan and subject Thais to a dark fate.  Take everything from the people including their self-respect to say NO.  I hope they wake up soon.

my thai friends are all educated middle class professionals or business people, and it's interesting, there's a pretty even split between those who hate the government because it's corrupt and those who support the government because it brings social and economic stability. for now anyway.

Wonder if that means the flying business to????

fight for their rights?

you need an army to do that, and that

army is allready in power...fighting for the rights...of his people !!
