My passport expires on June 28 and my embassy will not renew it here in Thailand. I was told to renew in my country due to new biometric requirements for a new passport. Does the July 31 amnesty apply to my situation? Am I allowed to travel with an expired passport if I was unable to exit Thailand before June 28?

 

Note: I have a PE visa which expire on same day as my passport but my membership is valid until November

You sitll need a valid passprt to stay in the country. You would not be able to leave the country without one.

The ministerial notice does not mention anything about passports.

Can your embassy issue a emergency travel document.

Mostly the answer is no, but there are exceptions.

If you are going back to your home country, an airline can, at their discretion carry you back home.

 

At the discretion of the airline, it may be fine to go home on an expired passport.

The view of the immigration officer on arrival is that you are coming home and as such all you need to do is prove citizenship, which an expired passport does.

 

The best is to get a laissez-passer to avoid any problems but once you arrive in your country there should be no problems, maybe minor but they wouldn't send you back to Thailand.

Correct for the flight home.

But not to stay here in the country or to leave without a valid passport. A valid passport or a emergency travel document is needed.

Officially you are not allowed to stay in Thailand on a expired passport.

But definitely you -can- leave Thailand with one, when you accompany the expired passport with documents like the laissez passer or any official document from the embassy.

 

Now many of us are staying here with expired visa, now with the emergency decree we get amnesty.

 

They did not include 'expired passport' as that group is small but it is not unthinkable that this is also include in the amnesty and I think it is up to the discretion of the immigration officer upon leaving Thailand.

 

But:

For extending visa and extension you need a passport that is valid for up to 6 months but the OP is on PE visa which can be 5 years and is valid until November this year.*  He couldn't has planned this situation and was planned to renew his passport at the embassy and now that they deny that and has to be needed in his own country I see no problem for him having his passport expired upon leaving but it would be good if he has supporting document with it.

 

Any other with a short term visa or extension would get issues as at the time of extension the passport need to be valid at least 6 month, expiring now is no extension given after November last year.

 

 

The OP, try to contact your embassy again requesting for the documents/LP and if that fails go to the immigration office for supporting document or sources which says you can travel with the current passport.

 

And come back to inform us, this is good information for us and other in the same boat as you.

 

 

 

* which highly will extend to next year if you come back before the membership ends, but with no 'PE' benefits only the extension.

There is not 6 month rule for extensions. The restriction for extension is that extension will only be valid to the day the passport expires.

If he got a emergency travel document he could leave the country with expired a passport.

He does have to have a valid passport to stay in the country. Without one to show he can be detained, deported and fined under the immigration act.
