90-Day Reporting for former amnesty permit to stay holders?

Featured Replies

A question as I am concerned about any penalties if I fail to follow correct procedures.

I was on the amnesty which ended 31-Oct.

Applied for extension with an embassy letter and was extended from 1-Nov to 30-Nov. (30-days)

Applied for extension with Covid Affidavit and was extended from 1-Dec to 29-Jan. (60-days)

Do I need to do a 90-day report?

When should I do it?

Is there a penalty if i I miss it?

Can I do it online? (I'd rather not have to queue up at MTT if unnecessary)

Thanks in advance for those who can shed light on these questions!

I have seen no reports of anybody with corvid extensions be told to do 90 day reports yet.

Thanks @ubonjoe.

I was concerned as this page makes no mention of who is required and/or who is exempt from the reporting requirement.  It just vaguely stipulates at the bottom:

 – If a foreigner staying in the kingdom over 90 days without notifying the Immigration Bureau or notifying the Immigration Bureau later than the set period, a fine of 2,000.- Baht will be collected. If a foreigner who did not make the notification of staying over 90 days is arrested, he will be fined 4,000.- Baht.

The info on the immigration website if a bit vague and does state the standard fine for late reporting. The maximum fine is actually 5000 baht as show in the immigration act. Disregard the last line since that does not happen.

Section 37 of the immigration act states this for 90 day reporting.

"5. If the alien stays in the Kingdom longer than ninety days, such alien must notify the
competent official at the Immigration Division , in writing , concerning his place of stay , as soon as
possible upon expiration of ninety days. The alien is required to do so every ninety days. Where there is
an Immigration Office , the alien may notify a competent Immigration Official of that office."

My suggestion would be to try and do the report at your local office. Reports were not required according to the ministerial notice approved on April 7th and then extended 4 times until October 31st which means in a way that the first report would be required 90 days after that day.

Thanks. So in other words, it may not be required if I extended under the Covid Affidavit, but....it also MIGHT be required?  As usual....office-dependent and at officer's discretion?

Technically you would have had to submit a 90 day report until about 6th November (until 31st October, but 7 days late is allowed).

But considering that we don't see a bunch of posts here of people who have been fined for not having done their 90 day report i would assume that most immigration offices don't want 90 day reports from people who show up every other month to apply for an extension.

Ask your immigration office what they have to say about this, in the worst case scenario they could fine you 2000THB, but most likely they will tell you that it's not required from you.

When I applied for my first 60 day extension in September, there was a piece of paper stapled to my passport instructing me to do a 90 day report in December. You also should have this stapled to your passport if required to report surely.
