What I'm getting at is : Can he prove to a court via hard evidence that he lent you some money?

 

Further,

 

Was it strictly a loan of money?

 

Or was there a definite arrangement for the other guy to share in any profits?

  • He know who, the judge?   I really doubt it, and as for the laywers, lucky for me, one of our big costumers is a laywer company, he agreed to help us at no cost, he said as well all evidence

    Judge should rule on what can be proven, ie what's in writing. Since lying is the norm here, verbal agreements don't carry much wait. But this LOS.     

The Thai court probably will want to determine if the money sent made him a partner/investor or was it just a loan. If he was an investor/partner then I would think he is out of luck. Business's close all the time. That's part of doing business unless maybe he can prove mismanagement of the business. If this was a loan and you borrowed the money then you may have to pay him back.
