The driver of the truck which stopped (to urinate) created the dangerous situation and is surely accountable in part for committing such an act. 

 

Meanwhile the driver of the other truck (the female) impacted a stationary object, driving without due care and attention?

I wouldn't be to quick to judge, so many trucks with filthy non visible tail lights, or tail lights not working at all.

I always found an empty Gatorade bottle to be a better option then stopping on the side of a highway,  a wide mouthed Gatorade bottle ????
