Pentagon Bars Biden Admin From Sharing Evidence of Russian War Crimes

The Pentagon has blocked the Biden Administration from sharing evidence of potential Russian war crimes with the International Criminal Court, according to officials with knowledge of the matter.

 

The intel reportedly includes details of Russia’s intention to target civilian infrastructure and abduct Ukrainian children.

 

Although Congress modified legal restrictions in December to allow the U.S. to assist Ukraine in court investigations, the behind-the-scenes tussle over whether to continue has the administration divided.

During such trials ukrainian war crimes would have to be investigated, as russia contest some of the very same ukrainian accusations. Russia is documenting war crimes as much as ukrainians, as they know they have to come with evidence at courts.

Evidence from the other governments, on top of the usa, would have to be allowed to be submitted and they might be contradicting.

So not necessarily the usa evidence will be judged as credible. And that would undermine american intelligence

All very true. But unnecessary.

At this time neither Ukraine nor the US has standing before the ICC as both have not ratified such authority of the ICC to prosecute their own citizens for alleged war crimes. As such Biden shouldn't have offered evidence and the Pentagon shouldn't have to "remind" Biden of the US lack of recognition of the ICC.

In the end....a nothing burger.

I seem to remember that the Rome Treaty provides that the ICC intervenes when a country does not or cannot credibly investigate and prosecute a crime on its own. This should negate the objection of the Pentagon. Also, when a crime is committed on a territory that is party to the treaty, it's logical that it doesn't matter whether or not the country of the perpetrator has adhered to the treaty. Maybe the Pentagon's precedent issue arises from the fact that the Palestinians have joined the treaty, but Israel has not.
