if it happened in the US it would be automatically jail time as you'd be arrested along with a breathalyzer test.  Fines would be massive, loss of license, and possible jail time.

I failed the brake test as there were only 2 pedals for an automatic gearbox. It took me several tries to explain to the lady that my Ford Ranger has a 5 speed manual gearbox and 3 pedals.

 

My right foot went to the brake pedal and my left to the clutch pedal which wasn't there, but is in my truck. I was also changing down the gearbox, which also wasn't there.
