Ombudsman ruled today (Monday) that parliament’s rejection of Move Forward party leader Pita Limjaroenrat’s renomination as a prime ministerial candidate was unconstitutional and agreed to forward the case to the Constitutional Court.

 

The ombudsman also agreed to ask the court to order parliament to suspend the prime ministerial selection process until it rules on Pita’s renomination, to prevent irreparable damage which may result if the selection process is allowed to proceed.

 

The ombudsman held an urgent meeting today to consider a petition, submitted by two academics, challenging parliament’s decision on July 19th, rejecting the Move Forward party leader’s renomination as a prime ministerial candidate, and demanding that the case be forwarded to the Constitutional Court for consideration.

Whether his renomination was unconstitutional or not is irrelevant as pita was ordered to step down due to an order from the constitutional court. Well that is my understanding but I am sure the experts on here will correct me if this is wrong.

Not related events. Nomination was unconstitutional as Parliamentary motion can't be repeated. Court ordered him to suspend from duty as an elected member of the House of Representative.

Ombudsman Asks Charter Court to Rule on Pita’s Rejection

BANGKOK, (TNA) -The Ombudsman has resolved to submit a petition to the Constitutional Court for a ruling on whether the parliament’s resolution to reject the renomination of Move Forward Party leader for prime minister was unconstitutional.

 

The office will also ask the court to postpone the next PM vote, now scheduled for July 27 until it delivers a ruling.

 

Ombudsman’s Office secretary-general Keirov Kritteranon said the office will submit the petition to the Constitutional Court to rule on the legality of last week’s parliament vote against Pita’s renomination after 17 complaints over the issue had been submitted to the office by MPs and people.

Ombudsman Seeks Thai Charter Court’s Ruling on Parliament’s Decision to Block Pita’s PM Renomination

National — The Office of the Ombudsman on Monday, July 24th, decided to ask the Constitutional Court whether Parliament’s decision to block Pita Limjaroenrat, leader and PM candidate for the Move Forward Party, from being re-nominated for the PM role is constitutional or not.


At a press conference today, the Ombudsman revealed to the press that it will submit a request to the charter court to determine the constitutionality of the Parliament’s decision on July 19th that barred Pita from being re-nominated for the leadership position.

 

Those who voted to block Pita cited that his renomination violated the parliamentary regulations which stipulate that once a proposal is rejected by the Parliament, it cannot be re-proposed.

There is also legal action being sought against the senators and if that makes it to court and succeeds what happens then

He was temporarily suspended as an MP while the CC decides on hearing his ITV shares case  that's the only issue. As a non MP he can still become PM if elected.

If I read this correctly. Pita was suspended from office until the CC concludes it's case. So, essentially, the ombudsman is pausing the voting until the CC finishes its case against Pita. 

 

"The ombudsman also agreed to ask the court to order parliament to suspend the prime ministerial selection process until it rules on Pita’s renomination, to prevent irreparable damage which may result if the selection process is allowed to proceed."

The order came from the CC, the ombudsman is now saying that was possibly unconstitutional, which needs to be clarified before anything can progress.

Bottom line is that the army powers will prevent Pita from becoming PM. 

There's is nothing you can do about this Ombudsman.

IT does not matter, Prayut and cronies will not allow Pita to bring Thailand into the 22  century.

As long as this group is around, Thailand will be a Communist <deleted> with no respect for the average Thai.   They are just the worker cast with no invitation to promote a modern democratic society.  All the surrounding border Countries are the same or worse.

No. The CC case is to do with the ITV shares, brought by serial petitioner Ruangkrai Leekitwattana. Pita had 15 days to respond and appear before the beaks in the CC to defend himself. Still has maybe 6 days to go.

 

The ombudsman's case is that the 2nd vote on the prime ministership was wrongly put to the vote by the speaker in the house, and got voted down by the senate and the other members of the vendetta against Pita on thoroughly unconstitutional grounds. Make no mistake. There is a vendetta, and the members are being named. They'll be running for cover no doubt soon.

Maybe take a look at who wrote the 2017 constitution. But he has had the decency to step forward and urge Pita to contest the banning from the Prime Minister nomination as unconstitutional. And I guess he should know.

Including the chair of the committee that wrote the constitution?

Think of the "Ombudsman" as a One-Man Committee.

 

In Thailand the first response to an issue is to form a committee.

 

No power or influence, ceremonial at best, always ignored. Just another in the sea of voices expressing "concern" about certain issues.

 

A gnat on the backside of the buffalo which is the current Thai administrative state. Annoying? Maybe. But easily swatted away with a swipe of the tail.

 

 

Let me try to get this straight since it's a twisted noodle.

 

The Constitutional Court barred Pita from being re-nominated.

Now the Ombudsman thinks this Constitutional Court order maybe unconstitutional and asks the (guess who) Constitutional Court to take another look under the hood...

 

Conclusion: Obfuscation can be a tricky thing, if you don't know what your doing you will look like inept numpties...
