The Israel Defense Forces said that Fernando Marman, 61, and Louis Har, 70, were in good condition after being rescued, following an operation that involved battles with Hamas terrorists and massive Israeli airstrikes in Rafah. Both were later reunited with their families in an Israeli hospital and were said to be in good condition.

Can it be judged a war crime if Hamas is a terrorist organisation and there was no war?

Israel is the Middle East  and he meant the West who support Hamas

   They were in good health ?

The IDF were stating that the two hostages were not injured in the rescue

With respect to hostages, the mission team found clear and convincing information that some have been subjected to various forms of conflict-related sexual violence including rape and sexualized torture and sexualized cruel, inhuman and degrading treatment and it also has reasonable grounds to believe that such violence may be ongoing.
