Former President Donald Trump's appeal regarding the ruling that allowed District Attorney Fani Willis to stay on his election case is set for an October hearing, a timeline that likely means his trial in the Georgia election interference case will be postponed until after the 2024 election.

The Georgia Court of Appeals has tentatively scheduled oral arguments on Trump’s appeal for October 4, as indicated by a docket notice sent to the defense counsel. The notice states, "A calendar will be sent to counsel of record confirming the exact date of oral argument." This development follows the appeals court's decision last month to take up Trump's appeal.

The appeal centers on a ruling that permitted Willis, the Fulton County District Attorney, to continue overseeing the election interference case despite revelations of her romantic relationship with prosecutor Nathan Wade. Due to this controversy, Wade resigned from the case following the ruling.

Judge Scott McAfee, who is presiding over the case, has emphasized his commitment to moving the case forward while the appeal is underway. However, Chris Timmons, an ABC News contributor and former Georgia prosecutor, noted that the October hearing date effectively ensures that Trump will not face trial before the 2024 election.

Last August, Trump, along with 18 co-defendants, pleaded not guilty to all charges in a comprehensive racketeering indictment. The indictment alleges efforts to overturn the results of the 2020 presidential election in Georgia. Several defendants, including Kenneth Chesebro, Sidney Powell, Jenna Ellis, and Scott Hall, have since accepted plea deals in exchange for agreeing to testify against the other defendants.

Trump has consistently criticized the district attorney’s investigation, denouncing it as politically motivated.

Pre-trial motions and rulings based upon the charges in the indictment is one thing. All the current motions and rulings are based upon the alleged personal indiscretions of the Prosecution. Or as Georgia Judge McBurney said of Ms. Willis in another ruling this case:

Fani Willis -- what were you thinking?

Well if she was a guy I’d say thinking with the little head…..regardless it’s ridiculous it has no bearing on trumps guilt or not

Expect a decision on a ruling to toss Fani from the case around March 2025 a couple of months afters 47's (most likely Trump) inauguration. More of the same, desperate but failed lawfare applied to ones political rival AND obviously superior.

Fani's ludicrous and feckless attempts at RICO are getting a beatdown by even the corrupt courts in GA now. Laughable.

If the cases are delayed and he loses the presidency run-off, those cases could hardly be dropped, which is something he must be very afraid of.

If he wins, he will pardon himself. But should he commit more offences while in office, will this mean he will continue issuing himself pardons (he could otherwise be impeached)  or just write a big, beautiful blanket pardon at the end (if he doesn't declare himself president-for-life)?

Just to note the "what were your thinking" was in reference to this not Ms. Willis' personal pecadilloes:

Judge disqualifies Fulton County district attorney from targeting Georgia lieutenant governor nominee in election probe

The judge said it was “harmful” to the integrity of the investigation that Fani Willis had taken part in a fundraiser for the GOP candidate’s eventual Democratic opponent, one of 16 fake electors she has been targeting.

Superior Court Judge Robert McBurney on Monday barred Willis from building a case against Burt Jones, a state senator running for lieutenant governor, after she hosted a fundraiser backing Democratic candidate Charlie Bailey in his runoff against another Democratic challenger who ultimately lost, Kwanza Hall.
