Can the Juristic Person at my condo provide me with a copy of my TM30?

You would think I could just ask her but the default answer for anything to do with immigration seems to be "no".

If I have reason to believe she can do it I will be more persistent if she says she can't, sometimes when pressed she is able to do things she initiallyย said she could not.

Juristic generally have nothing to do with TM30. Responsibility for TM30 should be one of the following depending on your lease agreement.ย 

ย 

(1) Condo owner

(2l Rental agent (if agreed in lease, may be a fee)

(3) you as householder of the property under lease. You will need copy of owner ID and condo chanote or house book

ย 

For background I rent out a condo whereby lease agreement says I as owner am responsible for the 1st TM30 and Lessor is responsible for any other TM30 required. In all cases rental agent offers to do the TM30 for 500 baht.

Bit off topic but I suggest all folk to check situation with owner cooperation regarding TM30.ย 

My Thai partner has rental condos and currently has two with farang tenants.ย 

Whenever they require a TM30 the agent does it (no charge)ย

What does your lease say?

ย 

Hint for others, make sure TM30 requirements are clearly defined in your lease and make sure copies of owner ID and Condo chanote/house book are included so you can do your own TM30 if needed

In many cases, personnel working a condo-office will handle TM-30s for the condo-owners who rent out their units.ย  The only way to know for certain is to ask them.ย

Who in Section 38 is who? In your situation,

  • householder = cdemundo
  • owner = owner of the condominium unit occupied by cdemundo, respectively the Condominium Juristic Person acting as agent for the owner
  • possessor =ย cdemundo

ย 

Now reflect upon the following:

  • Who is the first to know when cdemumdo arrives at the the rented condominium unit?
  • Given the frequent changes in immigration rules regarding the TM.30 notification without public announcement and the fact that different immigration offices interpret and apply these rules in different ways, who is in the best position to know how the immigration office used by cdemundo applies the rules at any given moment, in particular whether or not anย arrival of cdemundo necessitates a new TM.30 submission?
  • When cdemundo requires a service from the immigration office and the official finds that a necessary TM.30 submission has not been made, from whom does the official collect the fine?

The Juristic Person at my condo helpfully put together a pack including copies of the 80-year-old owner of the condo's id card and thabien baan. I just added the bits they had not included such as my entry stamp and my e-visa and the rental contract with the address of my condo and took it to Immigration to get a paper TM30. I overheard the Immigration staff complaining that when the condo had done the TM30 online, they had used the address of their head office nearby rather than the actual address of my condo. This essentially defeats the object of registering the address where the foreigner resides.
