Hi

My European  father moved to Thailand  and died there.

A soliicitorfrom Europe has applied to be administratör of the estate for dead father in court, but I never signed a power of attorney for this solicitor to represent me

 

I understand my power of attorney must have been forged ,  by this solicitor as read that the court will not register the case at all if  the children , all of them , have not signed power of attorney .

I am only asking about this, and the fact the court will not givee the case nr, as they pretend to not speak English when I call, spoke English with the same guy .

 

I am seeking help, but aware most legal ppl in Thailand and my country want a large down payment first, and then disappear with nothing done...

Thankfull for any info confirming my POA is needed as child in court.

If you are in Thailand now, go to the nearest Office of the Attorney General and ask them for assistance. It should be free.

Legal advice on wills, power of attorney etc, is offered by the Office of the Attorney General for free to all Thai residents, no matter their nationality. 

I now understand why from a Thai friend whose family spent decades in litigation after the grandparents died without a will - apparently Thais, especially the older ones, are v reluctant to face up to the necessity. Their case tied up the courts and enriched lawyers for years.

Also the lawyer may have thought there were no children and was trying to make a buck. Too many questions. Do you have the Will? Were you stated as the executor of the Will.  Do you have access to his titles? Unfortunately I agree with the guys above. If you are in Thailand then you best get some help asap. Also as far as I know, a Will in Europe doesn’t affect his property in Thailand, nor does his Thai Will cover anything he owned in Europe. Best of luck. This sounds like a tough one.
