Personal responsibility matters - being too drunk to function safely contributed to the tragedy. But the driver also had legal responsibilities he allegedly failed: driving safely, stopping when something went wrong, and rendering aid. Saying "it's 100% his fault" ignores the driver's charges and the duty of care that comes with being a paid transport operator.
