it's about my visa, i forgot to go to the immigration office to renewal, my visa has been expired for more than 3 months now, this month i'm planning to go to shenzhen - china, i suddenly find out this terrible problem. i totally forgot it for 3 months...... i already order the air-ticket on this 19th, is there any thing i can do now? can i leave the country? can i get on the plane? if there is someone know, please tell me what should i do, and what will going on in this situation, thx so much!!!

Firstly when did you enter? What type of visa? How long was the permitted to stay until stamp (date)? If you are reading the date on the visa itself that is only the enter/use by date - you can stay longer if your permitted to stay stamp is for longer.

If you are overstay that long you will have to pay at least 20,000 baht in fines before you will be allowed to leave.

Jerry, you don’t say with what visa you entered Thailand but anyway, the fact that your visa expired does not matter.

Look at the stamp you received in you passport when you entered Thailand, the stamp that reads “admitted <date> until <date>”. If the “until date” has expired, then you are on overstay and you will have to pay an overstay fine of 500 Baht per day but maximum 20,000 Baht.

i've found some information in this forum, lots of friends said if i'm overstay for more than 40 days, maybe i will get into the Immigration Detention Center (IDC), for some kind of check, if i have any other legal case pending. the tyep of my visa is ed, and it's expired on 28th aug 2007, it's nearly 3 months overstay now, the ed visa is for 1 year, so i totally forgot to renew it, and school doesn't remind me too. i'm worry about that IDC now, if they put me into there, how long will they keep me? can i boarding in time? i did't break any law in thailand, except this overstay, is there someone can tell me some detail. i swear i won't forget it again. about the that 20,000 baht, if i pay it, can i boarding immediately, or whether i pay, they will put me into IDC?

People are taken to the IDC IF at anytime during their stay in Thailand, are randomly checked by Immigration Police and found to be on overstay.

Then they are taken to the IDC, where you have to pay the relevant fine depending on number of days of overstay and have enough money for a ticket back home.

Just go to the airport, be polite, say your University didn't remind you about your extension and you didn't know about it either.

Pay your 20,000 Baht fine and you will able to depart without any problems.

I was in the same situation as you 7 years ago, but I overstayed 25 days.

You should not have any problem but you do need an influential person, university official or one of Sunbelts' Evil, Mean, Bad and Nasty lawyers* to go with you to immigration. :o If you are a Chinese national you can have a problem as the IDC does have a lot of people from China that illegally stay and are deported! Many of them throw away their passports and blend in and eventually just try and become Thai. Don't work out so easily but they try!

For convenience sake you should get the clearance from immigration in the morning and fly out of Thailand in the evening of the same day as an Immigration clearance always expires at midnight of the day it is issued. No they will not give you a 48 hour clearance!

I wrote extensively about the IDC and overstaying as I have some experience in this area! If you do a search on this you should find it!

*Actually all of Sunbelts' lawyers are very nice people but this is how immigration sees all lawyers and this is as it should be!

Are you prepared to chance it!   Take an influential person or Lawyer or you might enjoy a 10-14 days free bed and breakfast!   I have seen it happen!!!!!!!!!!!!!!

Jerry, if your "ED" visa expired Aug 28th, as of today Friday, you are 74 days overstay.

I wonder if you went to immigration and paid the 20K, if they would maybe still issue

you the the 90 day extension seeing as it was basically an honest mistake? It would

sure seem desirable to resolve that if possible before your actual flight date. As

Badbanker suggested, I think Sunbelt's price for assisting is 3-4K. Reasonable. :o
